Notes: Was able to add this case to "USCIS My Portfolio" only on 12/15/07. Reason: either my online address change AR-11 pushed it through or it was an IO who was trying to update my (beneficiary) address on I-140 (which actually cannot be done for beneficiary).

Topic: Ny Times article on Legal immigration

"Every year thousands of potential green cards vanish, like unused cellphone minutes."

...like unused cellphone minutes...

Typical comparative narration by dumb f**ks for dumb f**ks who:
1. cannot read, point blank
2. even if they could, will not read the article because they don't care
3. even if they did, will not understand the issue at hand because it is "too complicated"

Good o'l American ignorance. As with any other problem/stupidity we encounter here in the States, I blame it on a lack of proper education, government-cultivated arrogance/laziness, and short, very short memory of were/how this country had came from.

Useless article.

Topic: Neel Kashkari, the 700 billion man

"I'm a free-market Republican."—Kashkari, at an American Enterprise Institute conference, Sept. 19, 2008

Brrrr. This country needs LESS people like this Kashkari but it WILL have more of them, unfortunately. Another opportunistic faceless, spineless, nationless, selfless product of a necon conversion. Evil genius. Forgive me for an overlblown comparison, but... Zbigniew Brzezinski mini-me. His only ideals and values are not to have any ideals or values. He is not an Indian American, he is a cosmopolitan. Friends with AEI, CFR and other progressively-thinking "Americans".

Tell me, why is that first generation immigrants almost always are so much Republican? Assimilation fallout? Is it to make up for all the beating they got at the schoolyard? Is it to belong to the crowd? Poor them, they hate their other self so much.

Topic: "H4 renewal" with used EAD

You are talking about the entry visa, correct? Yes, as long as her intent is NOT to continue her past/current employment under EAD.

Topic: What's so great about America?

Original post does sound like Goebbels propaganda, doesn’t it? Somebody has to wake up here.

What's so great about America? Nothing is. It’s just another country, with its own pluses and minuses. Why do people "come" here, and stay, and (some) "bad-mouth" the States, but still keep on paying taxes and going out to see movies on Friday? Well, they come here to simply take back what has been taken away from them in the first place: US political and economic system, and style of life in general, exist at the cost of other nations, countries, and the whole continents. "Wealth" and "opportunities" are not equally accessible. Opportunities... bla-bla-bla. Capitalism is just like a zoo: only the fittest survive.

USA has some weird thing about it. It’s what Babylon was to Alexander the Great: you may conquer it but it holds you hostage to your "dream" and just doesn't let go.

Topic: I-140 receipt from Aug 16 07 Received data (Oct 2 Notice date) still shows as invalid on USCIS sytem

I-140: RD 08/06/07, ND 09/12/07
I tried to add my I-140 receipt number to My Portfolio since September but it was "invalid" until this morning. Surprisingly it already had soft LUD with date 12/15/07. What made the trick? I don't know.
- I did online Change of Address (AR-11 and I-485) on 12/14, which put soft LUD on I-485 next day, 12/15
- my employer called to update my address on I-140 on 12/14, went through tier two IO, who said "don't need to", and "actually we have no procedure to do that". Makes sense, as I am only a beneficiary. Did IO do something?
- maybe they sync'd their central db with Case Status Online on Saturday 12/15?

Topic: FP appointment missed due to not receiving the mail on time.

I assume that you HAVE received your ASC Biometrics Notices. It is absolutely no problem that you missed your appointment as long as you act promptly and go to your ASC to have your biometrics, FP and photo taken . There are two options:
- no appointment needed. You can go to ASC on any working day between the hours 8:00 to 10:00 but no later than 87 days after the original appointment day. No special arrangements needed, walk-in basis. Just don't delay it beyond 87 days. You have to bring your ASC Biometrics Notice and ID (explained on the notice);
- appointment needed. You can use ASC Biometrics Notice to reschedule your appointment by mail. Look at your notice: there is a special section for that. Beware, they can give you an appointment that may conflict with your schedule.

Make sure there are no fresh, unhealed cuts on your fingers or anything else that may fingerprinting.

Topic: Question Regarding FP

When USCIS sends you a notice to appear for FP/Biometrics - no LUD change.
But after we went to FP/Biometrics appointment at ASC, our LUDs changed the very next day. Only LUD change, status has remained the same.

Topic: I am in H1B but my spouse has got EAD

Incorrect.
Your H1-B status and your wife's approved EAD (based on AOS status) are completely unrelated. You can work as H1-B, and at the same time she can be employed or start her own business using EAD, or she can refrain from any employment and thus maintain her H-4 status.
The only thing: if she's using her EAD and then you travel overseas, and her intent is to return and continue SAME EAD-authorized employment, technically you cannot claim her as H-4 dependent anymore, hence she cannot receive H-4 entry visa at the US consulate, hence she should get Advance Parole for her re-entry (form I-131, it may take about 6 months to get it).
My wife and I are in exactly same situation.
