Is it true that you get EVL RFE only if you file non-concurrent ?

Do concurrent filers also get EVL RFE ? No reason as they process 140 which is from employer right ?

The dates are for 15th, but posted late.
Posting time is around 7-10 days.

They should actually changed the processing date to reflect posting date and confuse and make public less anxious.

Even DHS has no specific date. sometimes 8 , 10, 12, 14.
But mostly on even dates......................................................................Found the logic

TSC is ahead in 140 and NSC is ahead in 485 as per processing times.

Topic: When PD is current. Cannot start looking for Job

I think the case being looked at by office to adjudicate, should be guessed from processing times, rather than being current or not does not matter.
Now June 08 is PD for NSC applications.
So I can relax till the PD of NSC crosses july 15th,
That is when I should be ready with job offer and stop looking ?????
I am going to sign the offer tomorrow, but the PD of NSC will be updated April 3rd week, i.e this week.
So I think I should wait to see if dates cross july 15. If not, the pick the offer and change job.
If current , then stick with same company for 30 days and wait for RFE if at all it comes
If comes reply.
If not and 30 days cross , then start looking again ?????

It will be permanent job with consulting company and that is how most H1b's work right ?
You work for consulting company as permanent and then contract with the client.
This one is contract to hire with the client.
So I can protect the case for at least 6 months as permanent employee of company A.
then become permanent employee of company B.

Now can you clarify from what time we should stop looking or we should have offer ?
I interpret it as if the officer issues RFE for EVL, then you should already have had the offer and you cannot look for offer and then show to officer after 2-3 month ?

"Qualifying Job Must Exist at Time of Adjudication "
The foreign national cannot still be seeking same or similar qualifying employment when the examiner reviews his or her case. There must be an appropriate job offer at the time the examiner is ready to make a decision.

How do we know this ???

I think it is better to change employer as changing employer, means 140 is ported to different employer with all things intact in same occupation.

If employer shuts down, means 140 invalid as the job does not exist any more ???????

So first option seems to be better bet than wait for shutdown ??????

Actually my company was closing April 15 and so I started looking April first week and found a employer to start the job next week.
But later, my company got funding for another one month.
Now how do I reject the offer which I got, it is great. High salary, better experience and contract to hire in 6 months.
So in meantime will be full time with consulting company.

Also current employer, may shut down May 15th.
Dont know what to do.

But what I dont undestand in yates memo is " when the case is being adjudicated, one cannot be looking for same or similar occupation ?????"
What does this mean ???
Can you guys try to extract the meaning of this sentence ???
Is it possible to call USCIS and ask for the explaination of this sentence ???

Guys,
Need your expert guess here.
According to yates memo. The candidate cannot be looking for job when PD is current right ?
He should have either changed his job before the month that it became current ?
My PD is current or became current in APRIL and now in MAY.
Can I now switch job in similar occupation and title ?
Since I am july filer and they have already consumed 90% of visas for India EB2. I may not be approved.
But at least they will process my case and can issue RFE for EVL which I already submitted 1 year ago in july .
So what are my risks here ???
Should I change job this month or Next.
My company can close anytime next month , so I have to anyway start looking if not now , then after the month of MAY ?

I know nobody can tell the right answer, but your guesses can help make a decision.
I will get a lot more salary by changing the job.
