Topic: Green Card and leaving employer!
Hi,
fyi, Happened to meet my lawyer on saturday to thank him for all his help and asked him this question.
How long should i stay with my current employer as i see lotsa discussions in the forums. his reply was ...
One can leave the sponsor company the next day one receives their green card, there is no such rule any where mentioned that one must stay with the sponsor employer for 180days, etc.. As of Oct 18th 2000, we are free to move once we get the green card and do any kindaa work we want. Guess this is the date when AC21 came into effect.
He also said, before this date, yes, one should have to be with their employer for certain reasonable period( no mention of days) and then are free to move around. But from tha above mentioned date, there is no such restrictions.. and also nothing will happen during time of naturalization. He told me this very bold, ur free to quit ur employer right away. So am planning to move off next month as my GC was approved on may 27th and i got my card too on june 3rd.
Thanks. |

Topic: Transfer to National Benefits Center?
Hey Guys,
Herezz my interview experience.
We had our interview today, 5/27 at 10am and my wife's was scheduled at 11am. We were there at the office by 9.45am and met my attorney around 10am in the lobby after dropping the interview letter in a box assigned. We were just talking and by then a very nice white gentleman called my lawyer and was asking him weather he represents us. Seems like my lawyer and the IO knew each other. Btw, the IO's name is Mr. Johnson.
Once we entered into his dingy little cubicle, even before we wished him, he smiled at me and was telling this..
I am totally lost today by seeing your transcripts:)- Looks like he loves people who get good grades in university. He told me, even before we took our seat...
I am going to approve your green card right now, a Masters from IU, that too with 3.96 GPA, no more wait he said. Well, i felt this is day i was looking for.. i did not knew what i should say as he repeatedly commented about my GPA atleast 3 or 4 times..looking at me. he told that he was repeatedly seeing my transcripts again and again and asked me, when are you enrolling for Phd?? I told him am done:)- But my wife intterrupted saying she wants to go for it.
I felt ok, lets go to next chapter, enough of this gpa stuff.. its been almost 9 years now:)- since i got my masters
He told us, he does not know why i am been called in for interview, but told me show any thing that is new am having from that in the file he has, so..
i gave him the wedding certificate that we registered in cambodia and a translated copy, he said he does not need it as he already has the one i submitted from India. Then he asked for my wife's medicals and we gave him the I693 pertainig to both my wife and myself as the old ones are more than a year old.
He asked my wife, why she did not submit her medicals last year, we replied that she was pregnent and he smiled and asked what baby are you having.. we told him its a boy and handed him my son's birth certificate and his passport. He asked me anything else i can show him.. i told him about wedding pics.. and gave him the bulky album.. he saw few pics and said.. very colorful and nice pics...
then he asked for any tax returns and we gave him the last 3 tax returns, since i organized my docs so perfect, that he could hardly complete the sentence, the docs were on the desk.. he smiled and said, very well organized person your are.. i thanked him.
Thats it, he asked for our passports and he gave back my passport, but took my wife's I94 out and took her passport and my sons passport and took copies of it( as my wife passport was a new one, just renewed it)
he came back in a min and gave the passports, and then he took a form guess it is I-964.. or something like that, and was explaining that our marriage is less than 2 yrs, so after 2 months we must file this form.. then instantly my lawyer told, that this is not a family based case rather an employment based, IO was in a notion that this case is based on wedding.. then he said.. yes yes you( lawyer) are right.. this is employment based... then he saw me and told.. i saw his GPA today am am lost.. all of us smiled and then he told, he is going to request the DOS for visa number right away. ( seems like this guy thought my son's passport( who was born here) as my wife's and hence this is family based)
My lawyer reminded him that Since my PD is 12/2004, and am from India whose PD is not current. So he requested him that my wife's country of chargeability's visa numbers are available and the IO noded and told that yes i will use cross chargeability for this case, dont worry, i shall approve this case right away. Looks like today is my day:)-
then i was worried that why my I-94 is not been taken if he is approving my case today, so i asked him weather my I-94 belongs to him.. he gladly took my I-94 and said every thing is fine and i asked him weather he shall stamp our passports. He said, if your are not having any travel plans in 4 to 5 days.. then u dont need it. He told usually we say 2 to 3 weeks, but believe me u shd get ur cards in 4 to 5 business days.. even my lawyer told, not necessary.. so i told him, thats fine with us.
So everything happend in less than 15 mins. My lawyer was telling this is a very quick interview he has seen. IO asked, if we had any questions?? we said none and we just walked out of his cubicle saying Bye.
We thanked our lawyer who promised us lunch on saturday and said bye. Was thinking why not a lunch, if he made $500 for 15 mins:)- But we really like our lawyer, he is a very nice gentle man and a very reputed lawyer in ann arbor area. My advice, please take the lawyer with you if you are attending an interview, even if he charges $2000. Believe me, it is worth for one of two sentences they utter.. it is worth in gold. I saw that today.
we come out and my wife takes the pride in telling, no matter what ur.. still ur using my visa numbers( was telling myself.. "My Ass"). I feel little sad about it, but who cares we got our case approved.. he he he..
My only concern is, i want to see the card in hand, let it be 5 days or 5 weeks.. i shall be happy after seeing the card, 'coz i dont know what this absent minded IO will do once we left.. ha haha..
Hey, thanks guys for all the help, this site is been a one stop solution for all the immigration related queries, well maintained and mostly decent minded people use this. I felt annoyed few times when i dont see answers for my posts, but most of the answers i knew, just to counter check i used to pose the questions.. and also few of the users are very rude.. but if not for, this is a good site with decent crowd around helping each other.. hopefully every one gets their fair chance and all of them get the green cards pretty soon.
Once again thanks for all the help guys. Shall update once i get the cards.

Topic: Transfer to National Benefits Center?
Thanks sumagg:
So you say, the EVL must have job description? Just mentioning the designation is not enough??
If u want job description then, the EVL can include the duties, for example for a .Net SW engg, do we need to
mention that i know C#, VB, C++ and working on some tool , etc etc?? Thats sounds crazy. Kindly help out guys.
About I-864, my attorney told me that it is not necessary, because we already submitted I-134 while filing 485?
Just recent 3 paystubs, and last 3 w2 and tax returns should be fine? Is that true??
Thanks,
