I came here and overstayed my visitor visa. And I got married and filed for my GC and I got it easily in 4 months. It is not afraud to fall in love and get married. I dont know nobody who was rejected because of that. That is why they have an interview so they can be sure that you are married for real, but if you are they will see that. If you go home who knows how long it will take to come back here. I had a lawyer and he told me not to leave the country (especiially because I overstayed) because they wont let me back in here for 10 years even tough I am married. SO DONT LEAVE THE COUNTRY UNTIL A LAWYER SAY IT SO!!!! If you have any questions I will answer it.

When you file for your paperwork file for his too at the same time. My paperwork conbined (without Advance parole) was around 2000$. Maybe little less or more, I am not sure, I had a lawyer so I paid it in full. Good luck

Topic: spouse filing for citizenship but I overstayed my I94

I would contact a lawyer to make sure that he can apply for citizenship (due to he didnt maintained residency, so he have to make sure that he stayed in the country on and off for 5 years.) Immigration knows about when he come and go how much time he spend abroad. But you have to make sure that he didnt lose his permanent resident status by not being here. You need a lawyer for that, but if he can get his citizenship you are fine even if you overstayed, just you cant leave the country until you got your papers here. If he dont have the last 3 years of taxreturn, than you have to find a sponsor (who is citizen and make the minimum wage) who need to file his taxreturn with your paperwork. Why do you think he will be denied citizenship? Before he applies he has to find out about it. Good luck

If you are on tourist visa, dont go home he can file for you here. I was the same way got my card in 4 months. If you go home, nobody can guarantee that you can come back. It is not risky at least you are together and you can start working as soon as you got your working permit and collecting evidence on your life together. I got my working permit in 2 months. YOu will be fine.

I think you try to get a refund, and you dont need a lawyer on an interview. They will ask personal questions and if anything goes wrong, than they will reschedule you for a second interview and THEN you need to take a lawyer. If I were you wouldnt pay for a second time for somebody for something they dont even need to be there. If she refund your money (which I think she should if it was detailed in your agreement) is good if not than you lost that money unfortunately. I hope I could help!

I just read your question, and I just want to let you know that in my opinion yes it will be a problem because that is the first thing they will look at and you are going to answer questions about it. I would definetily put the same address on both license. Good luck!

I have filed about 3 weeks later that you have. As far as I know the fingerprinting is earlier than the approval of working permit. I did my fingerprinting bacvk in the middle of june and I got the interview letter on the first week of october sooo aproximetly 2 and a half months after fingerprinting. I got my GC in the mail inabot 130 days counting from the date of filing, but I didnt have any RFE. I hope that helps a little bit.
