Yes INFOPASS is the safest bet ... but I think, you will recieve the card in a few days. FYI - I received the cards in the sixth day after approval e-mail.

Topic: Passports for renewal sent to Indian Embassy DC : 3 months now

FYI - last year, it took over 2 months for my wife's passport renewal. I followed up in person (yes, my calls and emails were unanswered) and found out that the passport office in India (where her old passport was issued) didn't respond to their query. Later, I contacted the passport office in India and after a couple of weeks my wife's new passport was issued.

Topic: EB2I date movements ?

The current situation is a bit different - since most of the cases are Pre-adjudicated, USCIS can estimate the number of cases with a cut off date. So, the dates will advance slowly and accurately (based on the number of cases) unless they run out of visa numbers for the year.

This was in contrast with August 2008 when they randomly moved the dates by 3 years just to utilize the visa numbers (without any regard to priority dates). Later, the dates were rolled back in a couple of months.

Topic: H1 extension pending...drivers license expired...got a ticket.

Before court appearance, you should renew your license based on your H-1B. If you are waiting for H-1B approval, then your situation will be governed by the local state laws. Also, per the ticket, is it compulsory for you to appear at the court? Cant you opt for paying the file and close the case?

Topic: Is AP and EAD filing fee free for us?

Since you filed I-485 on August 10, 2007 the I-485 filing was under July 2007 visa bulletin which had the old fee structure. So, you have to pay for each AP and EAD renewal. All applicants who filed I-485 after August 16, 2007 will fall under new fee structure and are exempt from AP and EAD renewal fees.

Got Card Production Ordered mail today ... EB2-I PD 11/24/2004, Straight Case: No EB3-EB2 conversion, Used AC21 back in October 2008. My case was current since September 2009, Called USICS several times ... each time got the same answer (till February 12): case Pre-Adjudicated, waiting to be assigned to an officer.

Yes he can change jobs with another H-1B employer but he need to re-start his GC process. However, if his current employer does not revokes his I-140, he can keep the priority date. His new employer will become the GC sponsorer in all respect.

You can retain the earlier PD as long as the corresponding PD was active. Are you sure that employer B's (current employer) attorney requested priority date portability during I-140 / I-485 filing? That's where the answer lies.

How can you use a substituted labor when the corresponding I-140 was revoked? Employer B should have requested USCIS to use Employer A's PD at the time of I-485 filing. Labor subs do not exist anymore.

It depends what your definition of backlog is. If your AOS has been pending for half an eternity yet you aren't current, (retrogressed that is) wily USCIS doesn't count your application as part of the backlog. So you can rot forever and they can still achieve their rosy processing goals.



Correct, but the question is whether the retrogressed applications be processed so that they can be approved once the PD becomes current. FYI - It is typical for retrogressed applications that they become current in a particular month and becomes retrogressed again in a month or two.

That depnds on the purpose of your appointment. Sometime an individual's case is transferred from service center to the local office - in that case take appointment at that particular office. Otherwise to query about a case pending at a service center any office will suffice.

AOS and AP both assumes that you are residing in the US and travelling for short duration. But if I want to stay abroad for more than a year, then I would change the AOS application to Consular Processing.
