Topic: 180 days counting when i485 is pending
The counting starts from the 'Received date' on the I-485 receipt notice. |

Topic: filling I-485 from home county
You are ineligible for filing I-485 from abroad (outside of the US). Only option is to file Consular Processing. |

Topic: IF Obama wins?
I am against all sort of amnesties and CIRs ... good for the illegals but not for us ... in fact the 245i (sort of amnesty) of April 2001 still impacts us. |

Topic: EB2-India No Apprv after Oct 11th?????
Perhaps the demand for EB2-I visa number with PD earlier than April 1, 2003 is low. |

Topic: Need your advice. Please experts!!!! Time is running out!!!
Whether you use AC21 or not there may be a query on I-485 based on your work status during May to September 2005. Here, you started to work based on H-1B recceipt notice but your previous status was not H-1 but L-1 (since you got the L-1 stamping during October 2004). I am not sure about L to H conversion rules.
If you invoke AC21 then it should not matter if employer QQQ revokes I-140 as you have the option to respond to NOID. |

Topic: Recommendation to leave or stay in the U.S.A
Well, it is difficult to get a decent job in Canada due to high number of skilled immigrants. I would suggest you to hang in for another few months ... returning ot India is a good option too. Most of the cities like Bangalore, Bombay etc are very cosmopolitan: the communication in English only, will be sufficient to start. |

Topic: Another H1B transfer question under AC21
Yes your new employer can file the H-1B extension if your previous employer discloses the labor Certification information. On the other hand if your I-140 is approved then you can obtaon the approval notice from the previous employer and obtain 3 year extension (provided your priority date has retrogressed, 1 year otherwise). |

Topic: PLEASE HELP. Received Two year EAD today no I-140 approved yet
What's your priority date and country of chargeability? Perhaps your priority date has retrogressed. By the way the EAD is linked to I-1485 and not H-1. |

Topic: Suggestion: AC21 docs not reaching IO
It seems that there is no process to associate a AC21 request to a pending I-485 case. Only thing that works swiftly is I-140 revocation!! |

Topic: Any recent GC approval after RFE replies
A RFE indicates that someone is working on your case. If EB2 ROW visas are still available (and no demand) by the end of September 2008, these may be utilized in favor of applicants from India / China. So let's wait and watch for now. |

Topic: Got RFE today: I-485 India EB2 PD Mar 2005 @TSC July 2007 Filer, I-140 approved
Incorrect - a visa number is allocated only during approval. In other words, a RFE doesn't imply that a visa number has been alocated. |

Topic: Why are approvals so random?
Nonsense ... when a I-485 case becomes ready for approval the corresponding I-140 status get checked; if approved then then I-485 is recomended for approval. |

Topic: why USCIS is not touching 2004 India cases for I485 adjustmement of status. ????????????
Utter nonsense, labor certification has got nothing to do - once approved it's a done deal. TSC is opening a file, if approvable and PD is earlier than June 1, 2006, this gets approved. By the way TSC is neitherapproving by PD or RD. |
