You are ineligible for filing I-485 from abroad (outside of the US). Only option is to file Consular Processing.

Whether you use AC21 or not there may be a query on I-485 based on your work status during May to September 2005. Here, you started to work based on H-1B recceipt notice but your previous status was not H-1 but L-1 (since you got the L-1 stamping during October 2004). I am not sure about L to H conversion rules.

If you invoke AC21 then it should not matter if employer QQQ revokes I-140 as you have the option to respond to NOID.

Topic: Recommendation to leave or stay in the U.S.A

Well, it is difficult to get a decent job in Canada due to high number of skilled immigrants. I would suggest you to hang in for another few months ... returning ot India is a good option too. Most of the cities like Bangalore, Bombay etc are very cosmopolitan: the communication in English only, will be sufficient to start.

Yes your new employer can file the H-1B extension if your previous employer discloses the labor Certification information. On the other hand if your I-140 is approved then you can obtaon the approval notice from the previous employer and obtain 3 year extension (provided your priority date has retrogressed, 1 year otherwise).

What's your priority date and country of chargeability? Perhaps your priority date has retrogressed. By the way the EAD is linked to I-1485 and not H-1.

Topic: Application is in 'Adjustment Area'


I went to InfoPass yesterday (16th). The lady told me that my application is in "Adjustment Area"!! I asked what does it mean? She said "IT IS IN ADJUSTMENT AREEEEAA! ALL I HAVE IS THIS COMPUTER, ITS NOT HUMAN, IT DOESNT HAVE ANY OTHER INFORMATION, but they are working on it so you will hear somethign soon!!" Does anyone know what is "Adjustment Area"

A RFE indicates that someone is working on your case. If EB2 ROW visas are still available (and no demand) by the end of September 2008, these may be utilized in favor of applicants from India / China. So let's wait and watch for now.

Incorrect - a visa number is allocated only during approval. In other words, a RFE doesn't imply that a visa number has been alocated.

Utter nonsense, labor certification has got nothing to do - once approved it's a done deal. TSC is opening a file, if approvable and PD is earlier than June 1, 2006, this gets approved. By the way TSC is neitherapproving by PD or RD.
