Topic: Change of status (I539) from H1B to H4 got denied without RFE

I believe you need to re file the H4.

Because your H4 actually based on H1..

Any other members can correct me if I'm wrong.

I got REF on H1B to H4 COS. I don't know what yet what is that REF about, But does it normal? Can customer support tell on phone what extra evidence they need

Nope... they can't.

This is the nightmare of USCIS... no one can tell you anything. You can only wait for the letter to come..

painful.... and also don't be surprised if USPS deliever it to the wrong address... it happens.

Topic: Immigration Reform - Executive Orders

I actually believe that president Obama will announce an EO. The thing is.... It will always only benefit Latino community... I never seen anything benefited legal immigration .... sigh....

That's why I'm skeptical... I mean I really want to believe, but I got disappointed over and over again.

Topic: H1B Stamping - 221g @ Matamoros, Mexico

Hi, I am planning for f1-h1 Visa stamping in jakartha? Is it fine? Do I need to apply for a visa?

LOL you mean Jakarta?? That's my capital city and my hometown.

Yeah, I think Jakarta is the easiest consulate in THE WORLD.... Wait, i don't get this... you are applying for H1B stamping... that's a visa right?

Indonesian only get one year duration for the stamp. So everytime I visit my family, I need to do the stamping. I've done it 5 times so far. no more though...

Thanks

Topic: Received text yesterday on I765 which was approved in April

I have almost same experience.

My green card approved back in May 1st, 2014. Suddenly, yesterday, I got a text that my I-485 status says - On May 1st we register this permanent resident status, etc.

I got my green card already (the actual card back in May).

I think system glitch again?

Topic: H1B Stamping - 221g @ Matamoros, Mexico

Hi there,

I used to be on H1B (for 6 years). I'm not sure if this helps, but my country (Indonesia) is the easiest. I never seen anyone got white 221 G white slip (i have a lot of Indonesian friend who are in H1B).

Maybe you can try my country. I saw some Indians when I lineup on the embassy in Jakarta. (I have 4 stamps since Indonesian only give 1 year stamp every time). My wife has 5.

Every time I went there, I just submit my application, no question asked, just chatting, done in 3 min max. 1.5 waiting in line though (they only have 2 appt slot, so there you go).

Thanks,

Topic: TB Test Positive - What next

I'm one of those.

My doctor said - according to him -– I check the link and it’s legit - http://www.uscis.gov/tools/designated-civil-sur... and on the Civil Surgeon letters section they have this PDF memo called “Notification of Significant Updates for All Civil Surgeons”. Inside that memo:

Chest X-ray report is no longer required to be submitted with Form I-693. The Centers for
Disease Control and Prevention (CDC) and USCIS agreed to eliminate this requirement.
Language on the form and instructions has been updated or removed accordingly. USCIS
officers have been instructed to no longer request further evidence if Form I-693 is not submitted
with a chest X-ray report. (Note, this does not change the chest X-ray requirement itself)
Applicants who are required to get a chest X-ray according to CDC’s Technical Instructions must
still do so, and civil surgeons are still required to record the X-ray report findings on page 2 of
the I-693.

I got my I-485 approved with no problem

Topic: UK VISIT VISA from New York

I *think* the NY consulate accepts applications delivered in person, but I am not sure. The rules keep changing. For the most accurate and current practices, you need to contact the UK consulate directly.

Even if you were able to deliver your documents in person, they won't return your passport immediately (unless it's an emergency appointment, which is a completely different kettle of fish). So you're going to have to go at least a day with your passport in someone else's hand. I've applied for a visit visa about a half a dozen times and each time I've mailed my passport to them using FedEx, and they mailed it back to me.

The only exception I made was with my Green Card. Since I needed to keep it with me, I sent them a notarized copy (which acceptable to them).

Hi Averus,

Thank you so muchhhh for your reply. Actually yeah, according to the law below:

Section 264(e) of the Immigration and Nationality Act (I.N.A.) requires all lawful permanent residents (LPRs) to have “at all times” official evidence of LPR status.
Failing to have your green card with you is a misdemeanor and if you are found guilty you can be fined up to $100 and put in jail for up to 30 days. (I.N.A. Section 264(e).) A copy is not good enough, because the law does not use the word “copy” or refer to “other evidence” of LPR status.

I do agree with you. That's actually my concern (sending my real green card to them). So Notarized copy is acceptable to them I guess.

Now, if you don't mind, can you verify these supporting documents?

- a current passport or other valid travel identification
- 2 passport size color photographs
- My paycheck
- Notarized copy of my green card.

Anything else?

They said not to pay my trip before I got the visa. So I shouldn't booked anything right?

Thanks,

Topic: UK VISIT VISA from New York

Hi all,

I hope this is the correct thread to ask. So I plan to visit London as a tourist. I need visa since i'm Indonesian.

My question is, I'm hesitant to send documents to them. Is that the only way? I cannot just simply drop them off in NYC Embassy or UK consulate?

I work in Manhattan, so I can come by in person and pick my passport up in person as well.

Thanks,

Topic: World Cup and Green Card

A comparison of world cup spots with that of Green Card.

http://www.fifa.com/worldcup/teams/

You have 12 spots available for European countries alone compared to 4 for Asia 5 for Africa etc..
This is simply because there are more ranked teams from Europe.

Why this is not being followed in Green Card allocations where there are more qualified candidates from India/China :-)

Well, then Italy can send 4 teams then. Germany can send 3 teams, England can send 2 teams as well and no need for other countries to participate.

You are comparing countries with person. I don't think that's fair.

The comparison is it doesn't matter how good Brazilian team are, they just can send 1 team with same amount of players on the field with other countries. Same thing like India and China. No matter how many good person China and India are, they still can only send an X amount of people for green card for that particular country.

Also, I don't think you think this through, Europe has 8 groups and each has 6 countries in it. It only yielded 12 seeds to the final round of world cup.

South america (Conmebol) has only 9 teams and they have 5 teams qualify. Is it even fair? According to what? lol.

World cup is a game. same thing like green card. It's a game of life. Rules being setup by authority.

Nobody force any Indian nationality to apply for green card. No one force me to apply for green card. Sure yeah I want it. So since I want it, I follow the rules even it's unfair. Same thing like world cup. I think Turkey is better than Honduras sure yeah, but look, the rule said only 12 European team can qualify.

Topic: GC physical card delivery confirmed but no mail

So far, never missed any letter or an important document. Hoping for the best with GC cards as well. As i said, ill go to the local post office and talk to master in person today if i dont recieve them.

Hi there,

I also live in NJ (well your username said NJREBEL). The post office technically do not know anything about it. The postman who hand deliver it will know. That's your best bet.

For me, it happened a lot in NJ. I live in a condo complex and I got my water bill misdelivered to my neighbor mailbox.

For my green card, I took a day off, wait for the post man and told him I expecting a lifetime doc LOL. Anyways, moral of the story is, the tracking means nothing. If it's deliver it means it delivered. THE BIGGEST question is where was it got delivered???

I would suggest you check every neighbor. Also it might be delivered to the address that looks like your address.

Topic: 485 RFE - Original or scanned copy for RFE?

It has to be original. (at least in my experience).

My company produced one and scan it to my lawyer. My lawyer actually came back to email both of me and my CFO to send it ASAP to them via FEDEX. So my CFO did.

Topic: Questions regarding preparing for I485

If ppd test is positive you have to go to a radiologist?? Or do you get your physician to request chest X-rays and interpret them?? Did the doc who did your medical ask you to go to the radiologist??

The doctor refer me to Princeton Radiologist in NJ. I thinks she just being extra careful.

I read in Trackitt, sometimes USCIS wants the proof with Radiologist report. So I get both. In my report, there is Radiologist remarks and doctor remarks.

I'm tested positive for TB. After the doctor told me that news, I went to radiologist.

Took me only one day more for the completion of my medical. So it's not really a delay.

Topic: need help with TSC rfe

Thanks for your response mar2603!

So probably my lawyer sent the wrong address again and probably that will be returned again...

Could you please confirm if that PO Box address is this one as chetanpv said ?

USCIS/TSC
P.O.Box 852381
Mesquite, TX 75185-2381

Thank you!

That's the correct P.O box address.

In my RFE letter, the office explains that the GOld Sheet is the guide for the mail room to direct the RFE to the correct officer.

If you don't send it to the correct address with correct Gold Sheet on top, it will somehow at the mail room discretion to direct it. It could delay the it I think. Just don't take any chances.

Thank you for your response chetanpv!

My copy didnt come with the gold sheet. Only my lawyer's did. So I am quite concerned.

How long did your case update to "review for rfe" after your response was delivered?

Hi, I got RFE from TSC as well 2 months ago. I still have the Gold Sheet since both my lawyer and me got it.

It has a P.O Box address. It will got updated to RFE response review in one day. So if you send it to that P.O box, it will changed to RFE response review they next day.

Thanks,
