Hi wikiuser,
According to what USCIS decision said, I did not have enough evidence to be a 245i beneficiary.
So I requested my LC copy filed back in 2001 though FOIL, and I filed MTR with it.

Sorry for my late reply...
I got some lud changes online but nothing changed inside on my denied 485 nor 290B.

However, I got a letter by mail saying below.
Notice Date: July 26, 2008
'After review, we have reopened the above application or petition, or reconsidered the decision previously issued. You will receive a notice under separate cover once all action has been completed.'

Does this mean that my case is reopen?
Or just received letter? Then, will I get another message when my case reopen later?

On June 16, 2008, we received this I290B NOTICE OF APPEAL TO THE COMMISSIONER, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you.

I agree with CarolVa. The LC itself must be enough grandfathering of 245i and that is what my lawyer said.

Thanks GOD!!!, I got the record from DOL that I am the 245i beneficiery.
We are now on MTR stage. Let's see, how and how soon this will end.

And, krustycat, my PD is April 24 2001 according to DOL for my EB3.

OK... they denied my case because I do not have enough proves to show them that I am a 245i beneficiary even I do have FedEx receipt and the copy of doc sent to DOL back in 2001.
We requested to Phila backlog center for any doc to prove my 245i but I could not get any answer for months.
Please advice me if anybody had or having similar situation.
