I guess its something called pride.
employee based means you get green by yourself. althought during the transition you got raped on the pay check but at least when time is up, you don't own anybody anything because you already paid your due.
spouse based means after you trade up your freedom and all of your life savings with her but during the moment of argument, she will still yell at you "You only got greened because of me.. and etc." |

shoot... i just got off the phone with human resource and they say they don't have option for ead and aos to enter as visa type since i am non-resident.
and she is asking me to provide documents that would have my visa type
what can i do now?? |

I am change employer and invoking AC21 with EAD. However, they ask me to fill out my visa type on the employment form. What should I put down? I think I am no longer H-1B.. so do I put down EAD, AOS, or??

Topic: EB3 ROW that has priority date current as of October
It’s only the fourth working day of October yet many of us are ready to see visa bulletin for November and hope it will bring better news. Althought it's still early in the month but I have notice that approvals for EB3 ROW are not progressing significantly in comparison to other category. Could it be possible that visa bulletin retro to much and there are low numbers of qualifier of this month? How many of EB3s are current as of this month? |

This is just an update of my experience and to conclude this post for future readers. Few days after the Infopass, I received a letter by mail from Field Office Director and ask me for a level 2 biometric immediately, which they took my index finder print, signature, and photo. On the same afternoon of the biometric, I received an email from CRIS stating that my EAD is approved and card is in production. Then I received the actual card in approximately one week with 2 years expiration date. Finally...
The following information is solely my understanding and reading from various sources.
- It is not required apply for H1B extension if you currently in possessed of a valid EAD and willing to take risk that you will not have backup material if I-485 got denied. But as many suggested to keep H1B status simply for a peace of mind.
- One may inquire for an interim EAD at local USCIS office if the applicant have properly filed their EAD application and has not received a decision within 90 days of the USCIS receipt date. – wish I had known this earlier…
- One may start renewal of their EAD 4 month before it expires. Without H1-B status, one will not be authorized to work until EAD renewal is approved. But one will be allowed to work if USCIS has successfully received the extension documents even if their H1-B expired before the approval of the extension up to 180 days.
- One may start seeking for better job opportunity with valid EAD, approved I-140, and I-485 pending over period of 180 days. Applicant will be eligible to file AC-21 after they got the offer from the new employer.
- EAD has not restriction as requiring sponsorship from the new employer. But AC-21 requires the applicant to be in same or similar field and approximately same salary or higher as they stated in their I-485 application.

I see. Thank you so much for clearing that up for me.
But do I have to wait for it to approve to continue working? and is it illegal to work once my current H1-B expires?
If I may continue to work while the extension is pending then when is the latest date that I had to file H1-B extension? Just few days before it expires?
My EAD is still pending for over 10 months now and according to the csr/io(not too sure what to address them) from infopass. She say my EAD is waiting for my I-485 and she will write to the service center and try to get it approve seperately. But I am not sure if my EAD will get approve in time or not. The reason that I would want to avoid having my company to file the extension is because I already have anothing job waiting for me once I am done with my I-485...
Also I am about to marry a US citizen soon, would it be best to wait after approval of I-485? So many questions and under so much stress lately...
