Topic: The problems with a lawsuit against USCIS

I feel that any lawsuit that takes place must have clear objectives. This particular situation has never happened before and its hard to imagine that it will happen again so it would be good if there are clear goals than making sure "it never happens again". What would be useful would be a demand for a better forecasting system and some kind of sincere attempt to not waste visa numbers or introduce a rollover system.

Topic: The problems with a lawsuit against USCIS

It appears that the move to file a lawsuit is gathering steam in the AILF. However I wonder if this is the right decision. Firstly the fiasco was nothing more than a honest mistake and if indeed 60000 visa numbers were used up in June, it at least means that they are trying their best to clear the backlog (and making progress). Secondly, no matter what happens, the visa numbers are limited and no ruling will fix that problem. Thirdly, if the USCIS is embroiled in a law suit, it may very well slow down the whole system and lead to other repurcussions and delays.
I would be happier asking USCIS to give better forecasts based on their database and move on. Nothing is to be served by fighting a bitter battle when clearly there will be no winner.
