Topic: Background checks

What do they look for during background checks? My husband had an altercation with someone and involved the police, would that be grounds for denial of the green card? Or, if he had credit issues in his native country?

Topic: I-485 Denied - Urgent help is needed

I thought that you would have to have I-140 approved AND I-485 pending for 180 days to be able to exercise AC21. Was your I-485 pending for more than 180 days when you switched (Sorry, I just saw this in the profile)? Maybe it was too soon after I-140 approval to switch?

Topic: Stimulus and SSN

HI! Thanks for your response... When you got your recovery rebate check, did you get it separate from the actual tax refund? Or was it included? Also, when you completed the forms, was there an area where you write/type in anything about the rebate?

I don't know why my accountant just said no. I am planning to amend my tax return myself. I haven't seen the forms or where to write that only one of us got the rebate check, but I will check right away...

Thanks a lot guys!!!

Topic: Stimulus and SSN

I know there's been a lot of discussion about this. I originally thought that if one SSN is missing in people married filing jointly, there will be no stimulus. My husband got his SSN late last year, so, supposedly, no stimulus check. However, I received $600, which is contradictory to what was said.

Now, I want to claim the stimulus for my husband (an additional $600). Am I still due the rest of the $1200? Can I still claim it on my return this year? My accountant said he cannot get any stimulus check as he is not working, and that both spouses have to be working to be able to get the stimulus payments. I'm confused... Please help!!!!

Topic: AC21 and H1b

Hey there! I'm planning to use AC21 in a few months. A new h1b renewal was just approved for me. Do I need to tell my H1b employer to cancel it? Or, if I put in my 2 weeks notice, will that be enough notification for them?

Topic: EAD Valid Only For One Year

I received my renewal EAD only valid for 1 year. I am not current yet as per visa bulletin. I don't understand how this validity works. But, I thought that if there is no available visa number for me, I will be given a 2 year valid EAD.

Appreciate your comments.

Topic: Clearly visible - 90% AC21 facing denial issues

To the OP: researched or analyzed, it's your assumption of denial cases. Nobody is going to convince you that AC21 is good. It all boils down to ur risk. You said it yourself. You don'T want MTR stress. Simple answer to that? Don't change jobs, then. Stay where u are.

About that "analyzed" number, did u go through every single thread of ac21 cases here on trackitt? Actually, u should change ur number to 99% because there will only be 1% of ac21 approvals that u will see here. Check ur analysis.

Topic: Clearly visible - 90% AC21 facing denial issues

90% Of AC21 cases are facing denial issues? Where did you get that number?

Think of multinational companies with lots of money to burn. It may not be an issue of "ability to pay" for them. So, I can safely assume that they will not revoke any I-140s. Maybe there are other reasons, I dunno.

Please check your "researched" number.

Receipt notice November 7,2008. Checked online and it said Card Production Ordered November 17, 2008. In 10 days??? It's a renewal, though... So maybe that makes a difference... =)

Topic: H1B transfer after EAD use

How does this work? If I used EAD now, and I have H1B expiring in 2010, that will cancel my H1B right? So, say I've used EAD for 2 years and assuming it canceled H1B, and something went wrong with my AOS, can I still transfer H1B? Or, will it be a new application for H1B (From scratch?)

Topic: G-28 Question please...

Thanks Baires!!! I am thinking of using AC21 too. But, I was actually banking on one lawyer (private firm paid by my company to finish our AOS cases) to deal with just that, so, just in case my company wants to revoke my I-140, they would have to pay private lawyer to send in the letter (you know how lawyers get paid for every single thing they do?). And I am hoping that my company will not want to pay anything extra for someone who's not anymore with them.

Topic: Why wud Homeland Security ask employer to cancel approved I-140s

I thought CUSTOMS only dealt with goods (import/export)? Does Homeland Security have a Customs department? Why would Customs (dealing with goods) be interested in auditing immigration paperwork?

Help me understand please...

Topic: how to know whether i-140 has been revoked?

Hey namesake... I'm not sure how they go about revoking, but I've read that they only send a letter to revoke the I-140 and that's it, you're I-140 is revoked. However, say for example, your company pays a lawyer to do all their paperwork, I think every single request to do something the lawyer will charge fees. I don't think anybody would want to pay any extra fees... But, of course, I could be wrong...

Topic: G-28 Question please...

Question please... Is a G-28 form for one lawyer handling the AOS applications different from the G-28 form for the lawyer handling H1B? We have 2 sets of lawyers taking care of our paperwork, and I know I signed a G-28 form for AOS with one lawyer. And now, the other set of lawyers have sent me G-28 to sign...

Very confused!!!

Topic: 485 denied

MBAUSA, good news!!! Hopefully there will be no more problems for you. If you don't mind me asking, how much total did you spend on lawyers? Where can you start working again? When you receive notice that case has been reopened? Or, if you see online that case has been reopened?

Thanks a lot!!!

Topic: Is it possible that they will actaully come to the company and check if you really work there ???

If they come to check, I'm sure you're working there so don't worry about it. There is always a possibility that they will.
