what i meant here , you could have applied for i-485 through you employer by labor certificate so you can apply for i-485 after the third year. Actually ,you have a good point that your wife won't able to work that way. good luck

What can be done is apply for NIW, so spouse can get EAD. After 3 yrs of waiver are done, the primary can move, and apply through PERM, and port original PD. Original I485 can be withdrawn once new I485 filed for AOS through PERM or otherwise.

I had applied two I-485 since I had 2 I-140s... I withdrew the one with the later PD... Is anyone in the same boat? Just a little worried about this whole withdraw thing.... haven't heard anything frm USCIS so far... nor does the online system show any updates....

Topic: 485 approved after applying for H1/H4 extensions :) :( Please Help!!


USCIS will simply deny your H-1 extension as they will see that you are green card holder and they will send you denial notice where it will state that you are denied because your record shows that your permanent residency is approved.
The other option is to have your employer withdraw your H-1 extension.

Either way: withdrawing pending H-1 extension or waiting until they will send you denial notice is OK - it won't affect you green card in any way.

Interestingly, my H1 renewal came a week before I485 approval. My EAD was approved one day after the 485 approval. Maybe, it was too close for them to deny EAD? Hopefully it should not affect GC status.
I wonder whether I should now withdraw my pending AP.

Welcome notice email: 8/7/08, CPO email: 8/8/08. Received welcome notice in mail on 8/11/08.
Dependent got stamp in passport: 8/11/08 (for upcoming travel).
No cards or "approval notice" yet.

If your I-485 is approved, your AP is invalid and wont be useful to make a re-entry. So I suggest you go for Infopass and get your passport stamped. I am going to guess that even your kid would need that stamp to re-enter and as he isnt here, I think the local consulate should be able to help you out with it.

I am in the same position. CPO and welcome emails received 8/7/08. Tickets for travel abroad booked for 8/16. We are going to try and get the PP stamp at Detroit office. Anyone with experience there?
