shouldn't the rule be implemented to assign PD to a date based on when one gets qualified for it?

The job mandates the Requirement an individual either is qualified for it or not.

But the PD by definition is the date an immigration petition is filed.

So when you first get the date there is no category per se.

My wife got her EAD after 7 years in the US and she did land a job afterthat. Not a technology job but in accounting (She has a background her in accounting).

Until and unless you personally know the hiring manager this long gap is going to hurt. You relatively have to prove yourselves.

But she was broad-minded enough to realize that and applied for entry level positions. And she found one in 2 months. It is now 6 months into the job and recognizing her skills they are talking promotions already..

I think what helped her the most was she volunteered in a couple of Non-profit organization for 4 years in their office as a recruiter, helping them automating some of their mundane work, learning and applying some processes for their administration.

This gave her a feel for an office environment in the US and was easy for her to adjust.

Anyways, Good luck with your search and please update how your job hunts are going.

Your lawyer is correct. Please don't waste your money on the medicals now.

This new bulletin actually gives a better chance of determining when you want to do your medicals and it is certainly not now for your PD

I suggest go for it... If you are getting that much money and getting a Director Level position without a GC, then immigration status should be hindsight.

Here is the excerpt from USCIS site, that might help you out as well.

Q5. Can I accept a different position or receive a promotion from my employer and remain eligible to adjust my status to permanent residence?
A5. USCIS will evaluate these situations on a case-by-case basis. The job duties for each position, the SOC codes for each position, and any differences in the wages will be the determining factors as to whether you remain eligible. Regardless of whether the new job is considered a demotion, a lateral move or a promotion within the company for which the beneficiary is employed, the job duties must be sufficiently similar. USCIS officers will view the totality of the circumstances in light of the congressional intent, expressed in INA section 204(j), as enacted by 106(c) of AC21, to facilitate job mobility within the same or similar occupational classification for qualifying aliens with long-pending adjustment applications.

I think it is a case by case basis situation. So far that is the only case I have heard of or read about. The law firms always use such fringe cases to highlight the possibilities. I personally will not worry about it. You can only control what is possible

Here is my story... In 2004 I was consulting with a Desi company. Although I wasn't much affected I could see what was happening around and wanted to get out. These guys wanted me to apply for GC with them and I said I don't want no GC and even if I did it was not with these guys. So I waited for an opportunity to leave and switched to a FTE at the very first opportunity and vowed never will I go back to Desi consulting (remember this company was good to me but could see that they were morally corrupt with lot of other thjngs). And when I left I made sure I influenced at least half a dozen folks to leave and join FTE... of which 3 others did. In 2008 the FTE company I joined wanted to apply for my GC so they can extend my H1B.. even at this point I was oblivious to all the immigration circus. So I agreed and they applied... and guess what - they did it in EB3.. No big deal, I didn't know what it was. Things were moving along i got my 140 and a year later this company started laying people off. Luckily i held on to my job... However sooner or later i knew it may be me. But i didnt want to move bcoz I was making close to $150k...Company went through 2 more layoffs and my friends started asking how come you still with them and started drilling me about EAD and how come I hadn't applied. This was close to 2011 and this is when I started doing my research on GC process.. Came across terms like Visa bulletins, retrogression, porting, annual quota, spillovers, trackitt.com :), immigrationroad.com and inventory reports.
And I think the website that helped me was immigrationroad.com, not with information like trackitt, but analyzing my situation.

I was lucky my pd wasn't in 2009. So in 2012 I was looking for a company that will sponsor me in EB2... but even with all the uncertainties of a FTE.. I stuck to my guns, no Desi consulting... and after doing some research I realized if I timed it right I should have a GC in 2 years... November 2012 I got an offer from a company and although a six figure but way less than $150k.. And the timing was perfect... 2015 Jun I have a GC in hand...

follow your intuition and have faith in your abilities. If you are not with blood suckers.. keep away from them

With a degree from Georgia Tech just don't meander around waiting for your GC. You will have success irrespective. Trust me, life doesn't change much for people who have had success. And life doesn't change much for people who have been waiting for, well it buys an entry into the US without a visa though.
