For an example, if you are bringing your parents from your home country and your parents are staying with you in US for more than 180 days, you can claim them as 'resident dependents', apply for ITIN for them and deduct the dependent benefits from your Tax returns.



Well, the catch is that one cannot visit (on visitor visa) the US for more than 180 days. If your parents come here and stay over the 180 days (which is the maximum that the POE officer would stamp their passports for) then they're here illegally and not only can they not be claimed as dependants, but may also be deported and get you in trouble.

Topic: DMV sent a query to CIS

Was your DL expired? Here in VA you have to proof your legal presence if you let your DL expire. Then you have to show a birth certificate, US passport, Green card or a visa. May be the same in CT.

the above link just contridicts my earlier post. I guess the officer at POE cannot see whether your i485 is approved or not. This is very strange and hard to believe.

I think whoever you talked to gave you their opinions rather than the facts. You will not be let back in the US using AP whan you have your I485 approved. It does get invalidated the moment i485 gets approved. Now, with that said, that doesn't mean you will not be let in at all. I think that the IO at the border will see that you're a permanent resident and can at their discression grant you entry even you don't have the green card in hand. Of course depending on the day the officer is having they may make your life miserable and not let you in.

Similar thing happened to me coming back from Canada. I had a new passport and my visa (H1B at the time) was in my old one that i left at home. I never thought to get a stamp in the consulat in Canada and was coming just with my H1b approval notice letter. Well, first thing I was asked to do, was to read a paragraph on the notice that states "...this is not a visa and cannot be used in place of a visa". About one hour, missed flight connection and $300 later, I was given a visa waiver and was free to go back home.

Above is just an analogy to show that IO's have a lat of power when it comes to admitting people in the country - not a comparison of H1b vs GC

Topic: Question regarding Employer not paying prevailing wages

The best case scenario is that if your company gets audited by DOL they will have to pay you back the difference (between PW and your wage) from the day you filed your LC. Wouldn't that be nice :) although just a handfull of audits are initiated each year, so chances are small.

It's not correct that they can re-send RFE if you don't receive it in 10 days. You have to wait 30-60 days before they are willing to re-send RFE.



it's not that they cannot, they just choose not to do it asking to wait 60 days - just one of many burocratic trades of USCIS.

mjkkb2 if you do talk to your lawyer and ask why will she recieve the approval notice and update us here then it'll be great.
Not important but will be good to know. Hope they dont send GC to lawyers? Can they?



Just an update. I have indeed recieved the notice myself. (6/17/08). No word from the lawyher if she got a copy or not.

I belive what you say and I don't dispute it.

Maybe both my laywer an I will recive the approval notice - will see. After all she is my lawyer (not my employer's layer) my employer only used her for LC and i140 applications.

Will update once the notice comes.

that's what she told me after the CPO emails. She said to look for our cards in 7-14 days, and that she'll forward the notice once her office reseives it. Don't know why...
