thanks for your reply. On my H1B(I797) document, USCIS mentioned Consulate: Chennai, and also they said if I need to change consultae other than Chennai, I need to apply I-847(don't remember correct no).

So I was wondering will it be problem if I go other than Chennai.

Topic: H1 recapture and assigned to Chennai consulate

Hi,

My H1B was expired in June'08, and I never bothered to apply for extension as I have EAD. So I started using my EAD and unfortunately my I-140 got denied.

My attorney has applied for H1B extension in Oct' 08. USICS approved my H1, but they approved without I-94, and also they assigned Chennai consulate in my 797 document.

My qestion is do I need to go to Chennai only or Can I go to Canada?

What are the chances for my H1B visa stamping in Chennai?
Based on H1B, I overstayed almost six months though I have valid EAD.

Any input is appreciated.

How would I apply travel document? Do I need to submit any docs? Is it like visitors visa?

And I have one more question? I applied immigration for my wife and myself, and we both entered at the same time.
Now we have son, and he is American citizen. Do I need to apply any doc for him?, or we can just take along with me.

I really appreciate your respones. You clarified lot of things. I was complety under different track, and I thoight I lost my PR status.

Yes I have COPR(Confirmation of Permanenet Residence) document, and it says on 45th column Became P.R. ON: 10thJAN2007.

But this document says NOT VALID FOR TRAVEL. Can I use this document to enter into Canada?
