Close Review of the OMB Approval of the H-4 Employment and Other EB Programs Indicates Some Changes to Initial Proposals

Apparently, the DHS has made some changes to the initial proposals and the OMB approved the proposals consistent with the changes. Considering the text of the DHS' earlier press release, there appear to be no substantive or substantial changes. We trust that these proposed regulations may be published in the federal register very soon and we will find out all the details in the next few days.
The proposed regulations can be changed further during the final regulation draft process. The proposed regulation will first be published in the federal register with a period of comment (most likely 30 days or 60 days). Once the comment period is over, the DHS will review the comments received and decide whether those comments should be reflected in the final regulation. Once this review process is completed, the DHS may draft the final version of the rule which will take effect once the OMB approves it. Therefore, the draft of final rule will go through another cycle of the OMB review process ranging from 30 days to maximum of 90 days before the OMB approves it. Accordingly, the final rule may be published just before the November national elections at the best. Please stay tuned to this website for development of the final rule-making process.
