I believe, and this is only a hunch, that they are holding up sub labor applications. I am not sure if the adjudicating officer has anyway to know of that but...

Whay am I not getting approved??? Any clue from experts?
I tried Info pass, congressmen, send fax etc...I get reply that visa is not available. It says "USCIS is aware that according to the Visa Bulletin, there appear to be visa available. However, there has been extremely large volume of cases requiring visas; therfore, your category has already reached the maximum amount of visa avalable. You will need to check the visa bulletin....."

Any comments???


Is your I-140 approved? If so can you please fill in that field in your I-485 details. Thank you!

No LUDs after my first FP. I think that on in Aug 2007. But we got the second FP notice in Nov 2008 and but did not see any changes in LUD after the second FP was done.


Thank you for the reply. I took infopass end of Nov./start of Dec. Nothing new came out of that. I was planning on doing another one later this month if nothing changes.

You should have done this before but anyway search the forums for the fax no. of your service center and send them a fax along with some proof and detail the ordeal that you went through already. You should get your AP in a week or so.

Btw, did you apply online or paper? If you applied online did you send your photos? That might be one reason for hold up.

Topic: Do we have a chance getting GC?

Well, I am waiting for GC since last 4 years (with EB3 category). Its really frustrating after seeing January bulletin, looks like dates arent moving an inch at all. I see my wait time is for another 10 years. Gurus any theories? Is there a hope?


You might convince your employer to file a EB2 petition and recapture your PD from EB3. That is one possibility. Even then the wait ain't going to be short.
