Interview Experience: We are there at 730 and wait until almost 945 before we can get it. (turns out the IO is late for work). The interview only took about 30mins for both my wife and I. (the same old same old questions and none of those questions that may related to this interview (we thought) got asked.) And then the IO claimed our finger prints are expired and need a new set before she can approve it. And then she mentioned my Background check is not cleared but my wife. So we will wait and see.............

Topic: AC21 - Do you need a salary or can you work for a non profit or startup?


1. You don't have to send anything to USCIS, we have discussed this many times. AC21 is just a law allowing you to change the job. That's all what it is. If you want to inform USCIS, there is no harm in doing so. If you don't want to, no law requires that. What do you want to send them - it's only up to you. You can send them Christmas postcard.

2. The law doesn't specify for whom you can work and how much salary you can get, meaning you can work for non-profit and receive $1 a year.

3. The Yates memo also clearly states that new company can be anything or you can be also self-employed.

4. But!! There is a problem. The law says the job must be "same or similar". If you are a professional claiming to be making $100,000 after getting green card and if I were officer, man, I would never believe that you are gonna be doing that same job for $1. Remember, that the approval is discretionary. If the officer won't like it - he can deny or can request lots of stuff through RFE or put your case on hold for years. Getting salary is crucial in employment based categories, if you won't be making anything USCIS will suspect something and will give you hard time. I would avoid a job where the salary is much lower than one in I-140.



Well, there is a basic on the AC21... your job must be based on your LC & I140. And your I140 is getting approved (most of us do) are based on the LC and a job offer with so much salary.

So, it is as easy as lineay logic.... You must have a job with so much "salary" & "job duties" before you can get your LC and then I140 and then you can execrise your AC21. So, if you worked for a company without salary.. your are OUT of your case.......

Guys

How can we make sure that AC21 and new G-28 documents reached our 485 applications ? I know there is no standard procedure for AC21 and may not be possible to tell. But guys who already experience in this, can you please share with us ?

1)Did you see any LUD on 485/140 after applying AC21 documents ?





It is optional to send the AC21 paperwork to CIS. It is not required by law. In fact, my lawyer said save your time/money and she claimed she can deal with the RFE if for verify employer info from there. Then we got interview not becaz of the AC21 but becaz my wife's J Visa. Nothing happen, we just give all the supporting from my new employer and everything went OK.

Topic: Fingerprint rescheduling Question

I got my finger print appt set for 12/19 after the 12/1 interview. But becaz we don't want to waste anytime waiting, we walk in on Wed 12/10. One can show up and walk in to the appt. May be you can give a try... worst to worst case, you get return to home? No biggies right?

Topic: Travl back to US advice required.

we have our H status and AP and travelled a lot.. Then turns out, the AP never get execrised when we have our AP even we present everything at the POE. The officers kept saying H valid Visa is good enough and return the AP paper to us without even look at it.

Now, our H status expired and will use an AP to travel... we will see what it will come out...

Topic: Notice mailed welcoming the new permanent resident

I congrats you.. but you are not as long way as I am. I got a ROW EB3 PD 4/2003 and waiting for interview 12/1.
But I am happy for you. Enjoy and get a good vacation this season overseas without the fear that they will not let you come in. (And it happened to us one time 3 years ago when we are crossing the US/CAN border).

Topic: how long to get Green Card after interview???


I've already posted our story in several others posts.

We got the approval notice (from the local office) On March 2008. Till now, we haven't received the card. We already got 2 stamps in the passport. (the local office gives only for 6 months each time).
The case still shows that on Jan 2nd 2008 the file has been transferred to the local office for an interview. (Because of bad processing of FP. Twice. The case was approved right on the spot, Approval notice received 2 weeks later).

After ENDLESS infopass visits and phone calls to the customer service, we've found out that the case was accidentally archived w/o having it:
1. Marked as approved
2. Ordering the card

The local office didn't have any records of the 2 stamps in their records. I was shocked. I knew USCIS are a mess, but that was by far the most weird thing I've ever imagined.

OK. So we've asked them to pull the file out of the archive. They did it. But accidentally (yes again) it went straight to TSC w/o routing it to the local office first. Its been 3 weeks already since it arrived to TSC. and we are just waiting now...



When you said passport stamp, is it the PR stamp that can be used to travel?
Did you ever travel?
