Topic: H1B Pending - Security Check hold- 240days expiring on 7/3

I need Urgent Suggestion.

My H1B is pending since 8/12/2015. My attorney got following response from USCIS:
The status of this service request is:

We have placed your case on a processing hold because the required security checks remain pending. Until we receive the results of these security checks, we cannot move forward on your case. We require the results of security checks before we make a decision on any pending case.

We cannot predict when we will receive the results of these security checks. Please be assured that we will make every effort to make a decision in your case as soon as the security checks are complete.

I have following questions:

1. Can I work beyond 240 Days?
2. Do I have to leave USA?
3. Incase denied, what will happen.
4. Do I have an option to file a premium processing H1B transfer?
5. What may be reasons of Security check, has some one had similar experience

Topic: Porting Priority Date

Dear opinionencash and basoul83,

I was also under same assumption. My PD is May 2007. My Perm is pending currently. I spoke to my attorney to give him documentation for I-140 and 485, they suggested that there is some change in law now (He mentioned some FAQs) and it is not possible to claim your old PD (There is not a case of fraud here).

Thanks

I am in same situation. After joining company B, my I-140 was revoked. As per Rajiv Khanna, my PD is not good since employer 'A' have revoked my I-140. However As per Murthy, it is possible.

Please suggest if any one was able to get PD benefit.

Yes.. that seems to be reason as H1 Approval date is one day after the date of I-140 revoke.

Topic: Intent to Revoke H1B-basis of Revoked I-140

Friends,

Please suggest if any one of you had similar situation:

My friend changed the employer from A to B

1. B filed H1B and got approved for 3 years on the basis of Approved I-140 from previous employer A.
2. H1 was filed on 8/23/2010 Approved on 9/3/2010
3. Employer A revoked I-140 on 9/2/2010

Now received notice to revoke H1 on the basis of I-140.

Topic: Problem with attorney

Friends,

I have one desi attorney taking care of my case. My I-140 was denied and my attorney filed MTR. Now my I-140 is approved. My attorney has billed me for 8 hours @$200.. total $1900 for one page response to USCIS.

My PD is May 2007. I have not made paid as I strongly feel that he is over charging me (I may be wrong). I need suggestions on following:

1. Can I use some other attorney to file 485 when PD is current.
2. Is it advisable to change the attorney at the last stage.
3. Is there any way to resolve this.
4. Does 485 need lot of paperwork.

I also have one other question not related to this problem:

What all the documents should I keep ready to file 485. I read many post related to Birth Certificates. Please help.
