Topic: GC Filed Under EB1C and now getting terminated.

Amit ,

First things first please key in all your details...

What is the status of your 140 ..Is it approved ?

You are mentioning "GC thing" what are you exactly referring here .Your 485 or 140?
Do you have EAD?

Here are few options...

If you have approved EAD and 180 days gave passed after filing 485 then you can look out for similar job and remain here Until which date is your L1 valid? Do you have Advance Parole 131 document. Do you have any indication that your employer is withdrawing your 140? Is he forcing you to return back or are you free to locate another job.

As far as USCIS is concerned, unless they are informed specifically, the process will continue .. At the time of adjudication ,they might or might not ask for Employer verification letter . If that happens and they send an RFE and if you have found another suitable job in the similar field and assuming that 180 days have elapsed after 485 filing ,you can provide a revised letter .

If you are very lucky and assuming that your 140 is approved , and your employer has not withdrawn your 140 and USCIS approved your application without asking anymore documentation then you can be greened as well.. There are cases on trackitt where people were approved when they were sitting back in their home country ..

Now if you tend to use this GC( without bonafide employer) you might or might not be asked at POE ( point of entry) as to who is the employer and you can continues back ..

There are lots of ifs and buts and surely luck is one thing .. So that people can answer you better kindly enter your case details using this link

Topic: Filed under EB1 and project ends

Amit ,

Would appreciate if you enter your details in the tracker.

Did you file concurrently for 485 and 140 together?

Has your 140 approved?

Did you apply for travel document ? 131..

Is your company willing to get you back ?

Topic: EB1C Nebraska and Texas May 2007-Dec 2007 pending I-485 cases

We are stuck in the July07 pile ...neither are the dates moving ahead nor getting an approval..under these conditions nobody would entertain to open service request as we are within " Normal" processing time .. it sucks....what is the other way out other then calling them using POJ every alternate day.

Seriously need to think a formula to make somebody reach our files ..

It gets me a feeling like maneuvering Rover on Mars sitting here using remote control.. even that responds faster....

Canada..

Do they entertain personal visits to follow up on the pending cases and willing to discuss face to face ?? It would have been amazing if one could take the officer out for lunch and treat him with spicy Indian curry ....He would remember it for life time ....

Topic: EB1C Nebraska and Texas May 2007-Dec 2007 pending I-485 cases

New President in his acceptance speech yesterday night promoted the slogan "Yes we Can"

May be USCIS take a cue and say "Yes We can and We will " and start clearing these backlog and take some real galloping strides..
