Topic: Feb 2016 GC Approvals !!!

I have subscribed to USCIS case status updates and i received an update that my I-485 has been approved. Finally !!

PD: May 29, 2008 (I ported from EB3 to EB2 and retained my earlier priority date)
RD: Aug 20, 2015

Do any of you know if i will be getting the card directly or do i need to go to a USCIS office to get passport stamped before getting the card (Read that on an immigration website but not sure how current that blog is)?

I filed concurrently for both I-485 and I-140 last year in August after my PERM was approved. Concurrent filing can be done showing the approved EB3 I-140 and the new approved PERM.

My attorney informed me that my EB3 priority date wasn't captured on the approved I-140 and that they were going to request USCIS to amend.

I have a EB3 priority date from May 2008. I had my second PERM (for EB2 porting) approved in 2015 and we filed concurrently for I-140 and I-485 in August 2015. My I-140 has been approved now, but USCIS did not port my 2008 priority date. Attorney says that it is an error and that they are requesting USCIS to amend the I-140 approval with the 2008 priority date.

Does any one have similar experience? How long does it take for USCIS to correct the priority date. I was hoping that my AOS will be up for processing in Feb because the dates are becomming current, but this has become a pain now. :(

Gurus,
I recently had my PERM approved. I will be porting my May 2008 EB3 priority date to file I-140 and I-485 concurrently in EB2. I will also apply for an EAD for both me and my wife. Is there any advantage to I-485 or EAD processing by opting to file I-140 in premium processing? Is I-140 approval required for getting the EAD?

Advice please.

That is far from reality my friend. DOLs decisions are based on the certifying officer's judgement skills. Unfortunately most of them do not possess that skill. More often than not, they make bad decisions. Such decisions have a chance of getting overturned when the appeal falls in the hands of an officer who has some common sense.


You should always appeal a denial. You only lose a couple of months in the worst case.

My attorney filed a MTR on the 2nd of April. I am yet to hear back from DOL. So it looks like it is going to take about 2 to 3 months for DOL to process the appeal.

My audit was for the same reason as yours; asking me to file an affidavit that i didn't pay for PERM. Did you hear back from DOL after your MTR?

Congratulations ! Can you tell us when your appeal was filed? Mine was denied with the same reason as yours (background check on add, but not on 9089) and was appealed on 2nd April. Still waiting for an update from DOL.

No one except the attorney and DOL would know the priority dates. DOLStats is a website that just converts the A number to a date and shows as priority date. That in 90% of the cases won't be the priority date. It is the date on which PERM application was drafted. Priority date is the date on which it has been submitted. Unfortunately there is no easy way for us to know the priority date.

Got a response for my June 2013 PERM audit case and DOL denied it for a silly reason.

The job advertisement said that the employee needs to go through a background check once hired. That is not listed as a job requirement on PERM application (9089 form) because it is NOT. It is a post hire process that all hires go through. DOL says that since the PERM application doesn't have background check listed as a requirement, it is not a requirement for this particular job. Since the job advertisement says employees have to go through background check, it might have prevented some US citizens from applying for the job and denied my PERM on that bases. I guess DOL is concerned that law abiding immigrants will take away its criminal US citizen's jobs.

Attorney says they are going to file a MTR. Did anyone else have their PERM rejected for this reason? If yes, any luck with the appeal or MTR?
