Topic: "Standard" length of name check?
I am stuck in name check for last 1.5 years.
I have a very small hindu name First name 5 letter and second name 4 letter.
Can anyone say why its taking so long for my name.
If you call the 1-800 number of USCIS they have no information regarding my name check
clearnce.
In August 2007 I took info pass appopintment and went for it .
They said its still pending and dont know how long it will take to get the clearnce.
What can I do ?
Is there any number where we can call and expedite this process.

Husband and wife working on separate H1B's .
Husband applied for GC through his employer and added wife in I-485. This is how I got my EAD.
I started working on my EAD. So I think even if I started using my EAD, I can go back on my H1-B( as my H1B is not tied with EAD)...hope I explained my situation here.
Now different people have different view , some say i can go back on H1B some say I cant.
I will surely consult an immigration attorney here.
If I cant go back on my H1-B then i am in total mess. |

I read it, it looks like it is for the primary applicant(my husband in this case) who got the EAD and not using his/ her H1-B.
I was added in I-485 stage and started using my EAD after receiving it.
Will it revoke my H1-B too ? |

I think we can go back to H1B even after working on EAD. As my H1B has not be cancelled and it remains valid till it expires. |

Yes, I have a H1 B but I am not using it for more than a year.
Since I got my EAD I am using my EAD for work.
My H1-B is expiring in march 2008.
Right now in hassle of divorece I will have to look for a job who are ready for transfering H1-B .
My current employer is not ready to transfer H1-B.
I am being very polite to my husband .
Is just he has the card in his hands so he is playing with in for having full child custody and no support.
I have gone through so much in my marriage but I cannot sell my child custody rights for green card.

You all have been of great help.
Our marraige was not all just to get green card ,we were married for 6 year and we have a 4 year old daughter.
I am using my EAD and working on it ,as i have to support myself and my daughter .
Just the bad part is my husband is now using this as a blackmail weapon that if i fight for the child custody or any support from him ,he will cancel my Green card .
I have already posted this on murthy.com.
Its just that i wont go without my daughter out of this country ,no matter what happens.She is my life .
I know its legal to inform USCIS about the divorce .
But our divorce is still pending .
Even if divorce is pending,then also will USCIS take action to revoke my GC processing ?
Or they revoke it after divorce is final.
Is there any immigration law that I can be here in US as my daughter is US citizen.
As if I am asked to leave US I will loose custody of my daughter. |

Hi ,
I applied for my green card through my husband. He added me at I-485 stage.
My I-485 approval is still pending.I am pending in name check stage.
Its been a year my case is stuck in name check. I got my fingerprinting done in june 2006.
Is there a way I can expedite my name check or it will take its own time.
My husband has filed for divorce and if is possible that my green card application can be cancelled because of that.
I am already working on my EAD. Please can you tell me how can I protect my green card.
I have a 4 year old daughter. she is a Us Citizen born here. Can I ask state to provide me some kind of permit to stay and work in US as I have to take care of my daughter .
