Hi,

I had a similar situation couple of months back. I did a self-check to see if everything is correct while DMV is waiting for response from DHS. Self-check raised a flag that I-94 numbers are not matching and i raised a ticket. Called up the phone number provided and talked to them. I also informed my attorneys that I-94 is not matching between USCIS and DHS. They followed up with USCIS. Issue was resolved in a week and i got a new I-797 with another I-94.

Walked into DMV with new I-797 and got the license.

Try self-check and see if everything is correct.

Here is my understanding and view. I am looking at technical jobs perspective.

USCIS received 172500 applications for H1B 2015 of which 85000 are given the H1b's.
This means there are lot of job opportunities for which the companies are not able to find candidates. Either the companies have to wait for the next fiscal year to file for these jobs or send these jobs abroad for them to get the work done.

If all these candidates apply for green card, spouses will any how get EAD. Allowing qualified H4 to work early will reduce the numbers of H1B applications filed every year and as well keep the number of jobs being outsourced to minimum which is helpful for the economy in terms of taxes etc.

There are two points that are being raised (comments in articles etc).
1) Cheap labor
2) Jobs being taken away from american citizens.

1) I don't think companies would pay less if the qualified applicant is not from US. They have a vacancy and a pay grade for that particular vacancy. If someone thinks that for a certain job if the company is paying less for H1, then DOL would not approve the petition.

2) We have jobs but not enough people fill these jobs. We can see that based on the number of applications filed with USCIS.

I was going through this page and couldn't really figure out what "at the correct time" refers to.

"After the U.S. Citizenship and Immigration Services (USCIS) approves your immigrant visa petition, the USCIS forwards your petition to the National Visa Center (NVC) in Portsmouth, NH for immigrant visa pre-processing at the correct time."

As per this, I think USCIS has all the applications. Mr. CO checks the data from USCIS(in this case has all the applications including NVC) and also the remaining visas from DOS and moves the date accordingly. If this is the case, then he might have an idea of date movement and so asking the USCIS to send the applications to NVC which in turn sends out the NVC fee receipts for pre-processing.

Topic: Ya, 2 hours 1-way commute is really painful..

I was in a similar situation where my H1b renewal took about 5 months which we did not expect. I checked with our HR and as per them there is a regulation which will allow DMV to extend license for 240 days with an employment letter.

I got my license renewed with an employment letter.I had to show my H1-B receipt too.

4 years will be counted towards your experience. As far as i Know, the company in India will be considered as a different entity and you can count the experience for filing GC.

Topic: Custom won't give me a i-94 with my newly extended H1B date

i was in the same situation twice at EWR. The CBP officer doesnt know anything about I-797 and said he will give the date on the issued Visa(Passport) . I said i need to talk to his officer regarding this. I was asked to wait in a room which is generally used for secondary inspections. The officer in the room saw the I-797 and issued the I-94 with the date on I-797 without asking any questions. I had to wait for nearly 3 hrs each time.
