Hello Friends:

Received the CPO email on my case.

I NEVER CALLED USCIS about my case .

The ONLY rule I have followed in my journey is that Humans work at USCIS and if you or all of us keep calling them with a gazillion questions - we are being very wrong and asking them to STOP what they are doing and answer our petty questions for which most of the times we already know the answer from helpful sites / forums such as this one.

If my experience / thoughts offend anyone - Yes, I am talking about such people being a pain for USCIS.

Topic: F2B Visa Denied (Family)

Friends:

Sadly my sister who had waited for almost 8 years for her F2B Category (current per Aug09 Bulletin) was refused an immigrant VISA at Mumbai Today. Reason being our parents kept on going back and forth to India - since she was all by herself all this years and the Consulate questioned my parents residency status - to which my sister replied that they kept on coming back cause of her. The officer gave her a list of documents to be provided which would prove that they have maintained a Resident Alien status in USA. My parents have applied for a re entry permit twice and have not lived here more then 6 months in the last 3 years or so.

Please let this example be a wake up call for people in the similar situation.

I dont know if we have any hopes or not ? Do you think an Attorney might be able to put some efforts on it . Her PD was April 2001 under the F2B category - un married children of PR cards.

i guess we share the same EB2 Dec 29, 04 PD but I was not a 2007 filer , I filed my 485 after the 140 got apprvd .. so lets hope for the best !

so renewal it is - considering the expiry for my AP is Sep 09 !
my company is going thru tough times these days so h1b status may be lost if the company closes down .. so guys thank you for your valuable inputs and wish us all luck in coming days !

You have a very good understanding and since I do have a valid H1B stamped on my passport i should not worry about it - "UNLESS" i change my job or the company replaces me :) !
so in that scenario I think the attorney has a valid point in stating that One should renew the AP - the "probability" cause !

Yes you are correct .. but since I intend to travel sometime after sep 3, 09 - I was going to make sure if i needed to file the renewal or not - since the last POE was stamped as admitted untill June 2010. However, the previous post helped a lil bit stating that the expiry of the AP document is FINAL as stated and does not matter what POE date stamp for admitted says.

I completely agree with you but here's how the attorney's make you do things !

My attorney made me file the AP during 485 filings .. and now he claims that should you travel again - YOU will need to be PAROLED in USA since you have used it once and also it is safe to have it should you lose your current H1B Job !! So now, the H1B status is out of question :( !

The dilemma is whether I am covered until June 7,2010 or only untill sept 3,2009.

Now, since I anticipate travel this year again after september 09, Do I need to apply for a renewal of AP or I am covered untill June 7,2010 ?

We are in a similar situation .. can i ask you what was the term limit for your wife's initial EAD ..
My EAD got apprvd for 2 years whereas my wife's EAD for just one year expiry in Sep 09. I am debating whether to spend that amount of money or not .. but as you mentioned earlier that we had paid $1010.00 too .. so does that mean that we are not reqd to pay the renewal fee for $340.00 .. plz update. Thanks.

Got 3 soft lud's after the RFE was sent in and the case status just says "Processing has resumed" !

Topic: Visit visa for an LPR's mother from Pakistan

I would recommend you a couple of things from my personal experience - again its all about her - do not prtray the picture that you are well off to have her in US - that will just give them a reason for denial that you may just keep her - do not show that "YOU" need her to take care or stay with you - they do not run on emotions or else we all would have had our greencards since the day we file them !

Anyways, She has to have a liquid assets for atleast 3-4 months in her bank account - you gotta plan this visit - they will want to see and convince everything since she already got rejected.

2) Talk to a CPA in PAK and see if you can show some sort of financial Balance Sheet which includes her CD's, Property papers , Medical Life Insurance etc

so far thats the only things i can suggest and i know how important it is for you to bring your mom here and in all honesty i really dont see the reason why they should even deny her at this age. best of luck buddy.

hello guys - had a similar situation back in 2001 - no matter what you are or what you do here in USA is not what the consulate in india/pak is looking for - the golden question is - will you be coming back to ind/pak ? the only way i had to convince the consul for my mom is to keep researching own backyard to find a way out to convince to the consul that she "has" to come back no matter what - may it be because of property - estate - stocks - siblings - etc. hope you guys could think of something up which can help .. also do not say that or stress much about you being a LPR and that you will be paying her medical exps or as such - she should be able to prove that she will be capable to sustain the exps - if any as such. good luck.
