Topic: EB2 filing requirement and qualification

Given the current delays (EB3 from India/China not available at all, and EB2 priority date of mid-2006), I want to start a new case in EB2 and try to port my current priority date from EB3 case to new EB2 case. If all goes well and if EB3 priority dates don't retrogress more than my PD (March 2005), I should have speeded up my GC process.

Just my take. I see quite a lot of people doing this to help speed up, if they can file in EB2 that is.

Team - I have read (and re-read!) multiple discussions on this, and still feel compelled to ask it one more time to be sure. I don't want to guide my company in a direction without knowing the implications to me or the company. So, here goes.

If my company did a PERM labor cert, with a job that requires Bachelor's + 5 years of minimum experience, do I fit in this category with a Masters' with 4 years of experience? From what I have learned, the other way is true (that is, if the job requires Master's, you can fulfill it if you have Bachelor's+5yrs).

I have a EB3 in place already, but now want to re-file EB2 since all my peers were hired with minimum 5yrs experience requirement with a Bachelor's degree. I don't know how they did not use that format for me, and I am willing to take this to my management and get a EB2 started. I plan to port my current priority date (March 2005) when we file for new I-140 (my current EB3 I-140 has been approved for some time now).

Please advise!!

Topic: Will 1099 on your tax filing affect the decision on I-485?

I recently submitted my 485 app (RD June 27, 2007) and I did send my 2006 tax doc with W2s. Not sure if this is a USCIS requirement, and if there is any substitute doc you can send instead.

Topic: I140 and I485 pending, working on EAD, when should I renew?

From what I read here and elsewhere, EAD renewal can be a long and very stressful process. You are better off starting that now, for yours expires in December.

While I sincerely hope that you get all things done in the next 1 month, there is no telling how long you could be waiting. Better not take a chance for saving a few bucks for renewal.

My 2 cents anyways :)
