Topic: question about MTR for denied 485

You can check the online status but its not very reliable. Try to get an INFOPASS appointment. They should be able to tell you.

They can re-open your AP/EAD cases as well, or they don't, in which case you have to re-apply. You should really get a better lawyer.

Topic: question about MTR for denied 485

To be safe you should have filed separate MTRs for each (485, AP and EAD). Did your lawyer do so?

This means USCIS reconsidered the decision on their own. You should get a new notice for fingerprinting soon and the case will continue processing. Your lawyer should answer these questions. If s/he doesn't, get a new one.

Topic: Used AC-21 in past. Now laid off. Can I travel abroad on AP without a job offer

They can ask where you work. An EB-based I-485 is moot if the job or a comparable job doesn't exit. I have never heard of people being turned away at the border for being out of a job in EB-based adjustee/parolee status, but in theory it would be the appropriate step for CBP to do.

Topic: I-140 Approved

To qualify for EB2 your job must require a MS or BS + 5years of experience and you must fulfill those qualifications. Experience gained with your current employer doesn't count. Also, you fulfilling the requirements is not enough. The job must require at least that level of education. As I said earlier, most IT work does not require a MS, which is why everyone reports so much trouble when applying for EB2. If you have a PhD and do research you can qualify for EB2 through the NIW category, and for the OR/EA categories of EB1. If neither of these things apply, you will have to wait it out in EB3. On the upside you can renew your H1 now indefinitively in 3 year increments until your PD is current again.

Topic: I-140 Approved

The job has to be eligible for EB2, not just the individual. The vast amount of IT work is not EB2, which is why the vast majority for labor certifications is submitted as EB3 in the first place.

I didn't say getting an advanced degree (EB2) or PhD (EB1) or a miracle (re-capture bill in the middle of the deepest recession in US history) can't make it happen earlier for him personally, but EB3 in general will face a decade wait give or take. Reality is a scary place sometimes, but there is no way avoiding.

Topic: I-140 Approved

You have to wait for your PD to become current, which could take a decade or longer depending on your country of birth.

Topic: Are employers shying away from candidates on EAD

That is actually incorrect. In both cases you can get clearance through your home government, in particular if its a close ally like a NATO country.
