I think someone has write Mr Grassley that he was so against H1B. H1B is defined for skilled works and US never had shortage of managers. But companies has found a route to fool him via EB1C.

Topic: October 2015 Demand Data is out

It seems like USCIS proved again that they have impaired vision or number blindness.

In July inventory EB3 has: 25147

In Oct inventory EB3 has: 20,207

In July inventory EB2 has: 18744

In Oct inventory EB3 has: 18,714

Based on the inventory diff: 4970 visa issued.
Means not even 2800 assigned to the either category. Where did the spill over go.

Topic: Green card holders–days you can stay outside US in first 5yrs.

Could someone elaborate the following conditions?
Have continuous residence in the United States as a green card holder for at least 5 years immediately preceding the date of filing the application

What is considered to be date of filing application? Have they specified anywhere that it has to be filing date of I-485? Could we use the priority date?

There is a possibility of typo. EB2 instead of EB3 in CO notes. EB3 may move to Feb-March 2005.

clarification,

the tracker has only 5% to 10% of the total cases filed. So we are talking about 1200 to 2400 cases in Nov 2012.

YTD/Q1 Denied: 1532
YTD/Q1: Withdrawn: 680
Total: 12123 + 1532 + 680 = 14335

Rem = 16724 - 14335 = 2389

Trick Number below the chart: 29,344 Applications as of 12/31/2012

I don't think 29344 the number for first quarter. May be this includes all audited cases.

Any expert comment.

My comment was to share the thought not creating controversy among us. We all on the same side. Now I feel that this tread is becoming a war room as I have seen on immigration voice tread for HR3012 where people were cutting throat. Petition could be very helpful based on the timing. If this petition will be looked at before the USCIS completes its process, this will not help much. We should be hitting the hammer only when its hot.

I am confused with this nonsense petition. Why are you going after a petition? Are you saying that you are not happy with what USCIS proposed rule so you want take the congress route (senate and house)?

for knowledge, this petition is filed by USCIS in White House OMB. Which does not require a house or senate approval or petition.

So question is what we suppose to do here.

As explained by other commenters, we have to go to www.regulations.gov and keep and eye on 1615-AB92. When ever it is open for comments, add thousand of comments. Those comments will directly impact the rule not the petition.
