It is ok to use the EAD until its expiry, unless USCIS explicitly revoke it (Ref: Ron Gotcher). Your employment will be authorized by EAD, but your stay will be unauthorized due to denied I-485. Nothing to worry about once MTR is accepted and I-485 processing is resumed. |

Assuming that your EAD is based on pending I-485, your status is "Pending AOS". EAD is authorization to work and its not a status. Since you have lost your H4 status by using EAD, you are already in "Pending AOS" status, and you dont have to worry about your status until you receive a decision on your I-485. Once you receive your renewed EAD, you will have your authorization to work back, but you will never lose legal status irrespective of when your EAD gets renewed.

Exactly the way they hired 1500 people for naturalization application surge! Even if we assume that USCIS keeps processing 115,00 per year, these additional visas will make most of the retrogressed catagories current on VB and allow people to file I-485 and enjoy freedom of EAD/AC-21 etc.
I dont have any clue how this bill is going to harm anyone, so why not voice my support for it?
On a more serious note:
The bill sounds good and senator Lofgren will surely get a lot of votes from immigrants when her turn is up for re-election. Did she explain how the 216,000 visa is going to be distributed? And who is going to grant those visas? USCIS? Is there plans to increase USCIS budget to hire more people to use up the visa?
As it stands today, they don't have the manpower to use up 115,000 visa per year? How are they going to handle the additional 216,000?

Why make it sound so complicated? Here we have a bill that will recapture unused visa #s, and no matter whoever is behind this bill, it will help all the GC applicants waiting in line. Just pick up the dam phone, spend a few minutes to request support from these congressmen/senators and you are done on your part. Isn't that simple!!!!
Then you come back here on Trackitt and scrutinize the pubic hairs of everyone around! I bet you will spend more time in it than making the acutal phone calls. |
