Topic: AP renewal advise

Hi,
My current AP will expire on 23-Jan-09. I am traveling to India in Oct-08 and will be coming back using current AP in Jan-09 (before 23-Jan-09).

Please advise :
1. Can I apply for AP renewal in Sep-08 (120 days) and fly to India ?
2. Will there be any Issue? I know as per rule, the application can be assumed abandon if you leave before the approval, but the point is i) I will not be using the Renewed AP for the entry and ii) Renewed AP will be valid from 24-Jan-2009 or afterward

Topic: I-94, L1 expiring..HELP!

Use your EAD to show your legal status.
When you go to DMV show your EAD for license renewal (not your I-94 as its expiring soon).
You will not move to AOS status untill you start using EAD for work.

It was a pleasant surprise. Based on the current trend, I was expecting that it will take couple of months more.

And I know GC is far distant away but it’s a key milestone as AC21, 485, EADs (primary and derivatives) count on 140.

I hope you too will get the approval soon

Topic: Got only 2 copies of AP !

I got my AP documents in hands. It had only 2 original copies. Is it fine or there should be 3 copies?
Just curious if it will be a issue during re-entry.

You have to understand the difference between H1 petition and H1 Status. Both are different things, though H1 status very much depend on H1 petition.

H1 status is granted by the issuance of I-94 by:
1. CBP officer at POE, or
2. USCIS : I-94 attached at the bottom of the I-797 (as an approval to COS/EOS petition)

Your employer requested to extend H1-Status. By issuing I-797 (without I-94), USCIS approved your H1 extension petition but
did not extended your status.

" I-797 approval notice shows the H-1 status is valid till 2009"
Without I-94, it means your H1 petition is valid till 2009, NOT your status.

What I undersand is that you have got I-797B (without I-94) and your previous I-94 also got expired.

In that case you are out of status and than can be an issue when you try to return.

If you have received an I-797B, this means that the petition itself is approved, but the COS/Extension of Stay is not approved. You would have to go back to your home country to get your visa stamped, and then re-enter US.

You can stay in the country until the date written on your most recent I-94. The date on the I-94 is what determines the expiration of your stay in the US.

You will not abandon your I-485 by not using AP if :
1) If you were in valid H/L/AOS status before you left US. The H/L status is governed by a valid I-94 and not the Visa expiring date. AOS by a valid pending I-485.
AND
2) While returning you are still eligible for H/L status (Orig or extension) AND are going to work for the same employer
AND
3) You have a valid H/L visa at return (offcourse you will not reach till POE, if didn't have one :-) )
