Topic: I-485 and divorce

Take a good lawyers advice based on the thread it seems that you and your husband can make a deal ... tell him that if he withdraws UR 485 you will report it to INS under domestic violence and he also will not get his 485 approved,try to extend the divorce till then .In the mean time talk to UR company or find a different one that will start UR GC process, to be on the safe side.

Topic: Is it possible to file H1B extension with new employer without having previusly 140 approval copy?

Your Attorney should take care of it , if your GC attorney was hired by your employer change him/her. My attorney have filed H1b extension based on just the receipt number and online printout, so it is doable.

Topic: EB3 India PD 2004 how long we have to wait

Their is no need to file for transfer of H4 it is dependent on your H1b visa but make sure to file for extension before her expiration date of 2010, and her new I-94 will be vaild till the validity of your H1b.

Topic: lost my job. can i be unemployed during 485 approval.. please help!

Try to get at least a job offer letter in same or similar field,you don't have to join them when you comeback from India there is no commitment on the part of employer ... so if your current employer revokes your I140 or a REF for EVL is generated one does not have to worry about I485 denial and is covered under AC 21.

Note: salary is not a concern under AC21... so just get a job offer letter from any employer and you should be fine.

Topic: No H1B visa stamp and travelling without AP

I am a Canadian Citizen and have traveled to Toronto by car end of October07 and I had valid EAD/AP and H1b approval notice w/I-94 ( I797) valid till 2011. I contacted my Lawyer and he told me i don't need visa stamp and AP to reenter US but if I had left my h1b employer and was working on EAD (AC21) then i would need AP to reenter US. Therefore, I used AVR even though we HAD valid AP, my spouse is a Indian Citz (Canadian landed Immigrant). One more thing he told me was I can be working on EAD second part-time job while still working for the H1b employer... I can revert back to H1b status any time by reentering US with a new H1b (I94) stamp on the passport, provided my H1b approval notice is still valid.

Topic: What the fcuk is happening with EB3 India???

We should write to the Ombudsman and senator/congressman and ask them to address this issue to DOS, it does not require any Congressional intervention, the leftover visa numbers should be used firstly for the most retrogressed category and then to the others. The irony is even the unskilled EB3 category is at Jan.03... does that mean there are more Skilled or prof workers then unskilled ? I don't think so. As someone previously pointed out it already taking on average of 12 + yrs for EB3I to get GC?

Also stress the congressman to ask USCIS to published the number of people waiting in each category so that the wait time can become more transparent and the applicant can make an informed decision and not wait in a state of limbo not knowing how many people are waiting in line ahead of them and when will their turn come. Without these important stats the visa bulletin is also not effective in projection the actual wait time. I am going to write them a letter and urge all of the EB3 India to do the same, if we don't bring this to there attention then no one else will!!

Topic: Stats on EB3 India.

March,2003

I think we should all send letter to the Senators / congressman/woman plus to the Ombudsman... the leftover numbers from the year end should go to the most retrogress category, even the non skilled category is at Jan,2003. Is USCIS saying that there are more skilled workers than unskilled??? Pending cases number should be made public its been long time.

Topic: Is EAD better in this job market than H1B???

If you have h1b visa stamp or visa is not required (canadian Citz) and one wants to do part-time job on EAD while still working for the H1b employer , its possible to revert back to H1b status even @ post 6th yr scenario. I have checked with couple of Lawyers.

lets say IF your 485 gets denied , on post 6th yr H1b valid till Oct, 2011 and you are using EAD for part-time job one can still revert back to H1b status provided the person still work for the H1b sponsering employer...all s/he has to do is reenter US to reactivate the H1b status ( need to take two pay stubs & EVL at POE inspection).
