Topic: Parents of future Greencard holder or Citizens

Why do we assume that USA is the only place in world where ppl can be happy. Whether it's just born baby to 70 yr old parents. We just assume that their happy place is USA.
Sometimes I feel ppl should allot sometime to them selves and listen to what their families are saying

Don't force our ideologies to either our parents or children

Topic: February Visa bulletin cancelled or what

Not trying to be rude, but these days lost hope on humanity. Other day I was reading on murthy forum. The person assumed, getting I-140 approved means the employer cannot fire him. I had to read multiple times, if I got the question right.

I see your sarcasm now :)

Topic: February Visa bulletin cancelled or what

I hope you are being sarcastic. In USA, or anywhere, these days 1 year is a huge time. Anything can happen in 12-15 years.
Sidenote, if you think about it, this 2008 PD we already had it 2 years back. Whats the guarantee that it won't retrogress?

Topic: Role changed in Visa extension, will it impact I140

I work in US based company as FTE. Am in the similar boat. Talked to HR. To be sure talked to lawyer also. They said it should be fine. Since my PD is may 2014, will redo perm in 2021-2022. If both HR and lawyer said same , I believe I should be fine.

The only downside is HR 392 is passed and your date is current. (Being sarcastic)

Topic: Why IV so eager that H1Bs pay $1K to DACA illegals in HR 392?

I personally don't see any wrong in paying money. I am not against IV. But this proposal of IV brought back our old Desi values imbibed in our minds. Throw money at the problem.
Not criticizing anyone, but if you think about it , for a good school , tuition, colleges etc we always relied on parents to spend money.
That attitude did not work until we were in GC backlog.
And some how I feel some ppl back to the same thinking. We are thinking if they throw money they can hey GC. ;)

Topic: H1b extension If restricted : Existing Financial commitments

That hypothetical kind of situation is not new. Similar things happened if not same thing.
Every recession had these stories. Back in 2000s I heard ppl left country by parking car in parking lot of airport, and calling their banks that they are leaving this country for good, and left car in so and so parking lot. I just heard them from second sources, FYI, don't quote me on that.

I believed in 2007-2008 situation might be similar, but did not hear things like 2000s. But ppl lost houses, that I heard. banks will sell them as foreclosures.

Even a US citizen if he loses a job, its a painful, long journey to get to food stamps situation. We are not billionaires to declare bankruptcy next day, and our slate is clean :)
As earlier mentioned, financial history will be screwed

I heard that of it's lower , USCIS will ask your employer to pay the difference that he hasn't paid. If you are above that level nothing to worry I guess. Thus is all I gathered info from forums like here so do not trust me

You might be right. But what if 6 yrs down those wives get I 485 approved or get GC, because their husband is good candidate? Again the same candidates are in the market.

Fyi I am also from that state.
My point is things will get worse as we age, irrespective of what ever happens

Topic: H1b AC21 Cancellation: Trump's Nuclear option

Not trying to debate if AC21 cancellation theory is right, or wrong . But what you said is true. If we know the future is certain, it is always good.
Big companies, can always off-shore things. We do not have clout to do anything. Even that hr.392 is BS, I think.

Even if nothing bad happens, and we all get greened in our lifetime, it doesn't hurt to have a plan B.

Topic: H4 EAD Revocation rule

I believe the opposite would happen. The main reason for anti immigration is because h1bs are used to replace the citizens. Would a person who has worked for 6 years or more would work for a less wage? If so why?
Most of us lead a comfortable life here. If anyone thinks they got a job by laying off a citizen, then those ppl need to go.
Coming back to your point , any immigration rules only screw common man. Big mnc they keep bringing new h1b every 3-6 yrs..and once they bring them the employee does not leave and there will not be attrition . Because there is no incentive to go to other company. The actual problem of citizens loosing job will not be solved. Because a fresh batch of h1b will come after 3-6 years

I believe when republicans were asking for merit based immigration, some lawyers and key board warriors in forums like here were asking this is not possible because of AC21 blah blah and legal implications..I think IV is shooting arrow in the dark saying they might repeal that.
Any way according to your logic ... making h1b for 6 yrs will not decrease citizens problems.
Actual problem from the perspective of US govt is I think, is the new h1b coming from India. And new Opt students..

Topic: IV Call today Dec 17th

Just a rant, posting on this forum thread. Not complaining to anyone, nor trying to make a point.

Just curious, did anything good happen for us in last 5-7 years due to IV?
The only claim I heard is H4 EAD became possible because of them. And media say its becoz of previous govt.

They say they predicted, repeal of h4-ead this last year. Ya, going by political wind, some ppl without any law degree made a guess about that.
I remember they saying, last year that they are fighting H4EAD lawsuit, Did they drop off their fight against law-suit?
This is like someone coming after thunder has stuck, and say, I told you so, which doesn't help anyone.
There is a saying , even broken clock is right twice a day.

Can we be sure that hr 392 passes becoz of them?
Suppose, for suppose the repeal of AC is true, is there anything they can do? Or is there anything we can do except to move to another country?
I am also panicking, just like anyone in this group. Won't be able to sleep 2-3 days now.

I keep failing to understand why we keep this stupid blind faith on someone and do this hero worship. This happens from our bollywood heroes to IV, we keep supporting them irrespective of the result.

As a matter of fact, I appreciate ppl who rallied, talked to congressmen for HR 392. Its a positive thing.
But , I lost hope on that also.
I am thinking that effort is in vain.
If our own house was good and comfortable, and our own brothers and sisters were helpful, why would we be in this situation.

Topic: H4 EAD Revocation rule

Remember, 2 years back for the OPT guys the extension was in danger? They made a rule, and passed it in months to make extension.
Already this govt is facing heat, on various issues. I believe they want to show that they bought back 100,000-150,000 jobs to US citizens which obama gave away.

Not trying to be negative here,..sharing my two cents..but this seems like H4-EAD is gone.
If you guys think otherwise, I will be more happy. My wife is on H4-EAD. So I do support EAD for H4.
Remember, 2 years back for the OPT guys the extension was in danger? They made a rule, and passed it in months, if I remember correctly.
Things changed, govt changed, if they want to change, they could do it ASAP.

All ppl who used to cry on social media about H4EAD, congratulations. May be you guys did it. Our enemies are not somewhere, they are our own people.

Uncles who already got GC cry on existing H1bs, H1bs cry on H4 EAD...the cycle of crying, heart burn on others continues....

Topic: RFE on H1 Level 1 Wage

Lately due to personal reasons could not keep up with forums. Have seen full time guy working in US based product company got h1b extension denied. He is been on h1 since 2007.
Is there any pattern or trend in these denials?
I did not ask wage level SOC code as this is not appropriate time. Just wondering, is there a definite pattern?
I was that person who would doubt every single person on internet. But this time it happened to my colleague. So curious as my extension is round the corner
Sorry of this is obvious question.

Topic: EB2 Role Change

Hello.

I completed my 6 years on h1b this January 2017. My employer started perm process in 2013, and my PD is May 2014, have approved I-140 now. (Have new h1b extension from Jan 2017 to Jan 2020. Also my wife is on H4 EAD. Just giving the background , not sure if its relevant. )

In the perm process, they had filed as lead database engineer. Now I am trying to shift roles with in the same company, to Automation engineer. I contacted HR, and they said, they had to talk to lawyer and see whether I should re-do the whole perm process, after discussing about the new duties in the new role.

As I am in Eb2-India category, and PD(Both final action dates and i-485 dates) doesn't seem to move beyond 2009-2010, was wondering why go through the whole process again.I have these 2 questions. These might be very naive questions, but please bear with me.

1) Can I ask them that, I will change the role, but not do perm process, and lets keep i-140 as it is. Will that be a problem?

2) I am not sure, if I can ask this, I am thinking to ask my manager, that I do both DB engineer job and Automation engineer(40%-60% or 30%-70%), but on paper for immigration purpose, want to continue as DB engineer, so that I don't have to change the immigration. Will this be a problem when I am filing for I-485?

The reason I am asking these 2 questions is, I may change my employer in 1-2 years, so I do not see any point in going through the whole process, which takes minimum 2 years again.

Please advise.
