Topic: EAD for H4 Visa Holders

My check is under processing, so hopefully my documents are accepted. Although I haven't received any text/email yet. I did call USCIS service center and the representative told me to send the photographs as soon as I receive my receipt number to the next USCIS office address mentioned in the mail where further processing will be done. So unless the office needs more documents (other than the photographs), I shouldn't receive any RFE. Fingers crossed.

As I didn't attach my photographs with supporting documents, do you guys think there will be delay in issuance of card? Should I send it on its own or do I have to wait for some kind of response?

I didn't attach any photographs with my supporting documents. What can be done now? Will they ask for it?

Is it mentioned somewhere that it's not? I am not sure. I always assumed it's part of the process.

Documents reached on 28th at Phoenix location. Check is under processing status. So hopefully might receive a text/email soon. I do have another question though. Does anyone know how much time it will take to get through biometrics? I have to go to India on June 30th and I have read a it's better if we finish the biometric s and then leave. Let me know if you have any information.

Topic: EAD for H4 Visa Holders

Hi, I am very confused about the second eligibility criteria to apply for an EAD. It will be very helpful if someone can clear it for me. In my husband's case he had an approved I140 from his previous employer and he also has an extension on is H1B (two 1 year extensions and currently on a 3 year extension period). But then he quit his job earlier this year. Now he is in his 9th year of H1B but his new employer is yet to file for his Perm. They say they will start the process in Jan 2015.
What I want to know is if I am eligible for an EAD even if the Perm application is not file. Do extensions from a previous employer fall under AC21?

The employer and client both are same, they are filing for extension regardless of the end date approaching soon. I do understand that LC would have to be filed all over again after the H1B is transferred. My question is, does the fact the husband has already finished 6 years of H1B, do any good for me if the rule is implemented and I want to apply for EAD. Or do I have to wait untill the new employer files for LC and I-140 is approved again.

Topic: EAD for H4 Visa Holders

Hi,
I have been following this forum from few months now. My case was fairly simple if the proposed rule was passed (approved I-140 and extended H1b) and my hopes got high after 8th of April. However, I just got to know that my husband got laid off. (Bummer!). The company agreed to file for another 3 year extension before the last working day, I do know that the I-140 approved will not hold any relevance with regards to this rule as he would have the LC filed all over again. Can someone pour his/her insight on such a case. Will I still be eligible for EAD considering the husband has an extension?

Your replies are very much appreciated!
