Topic: 7 th year H1b, LC not filed late?

I think as you have more than 11 month of H1B from the date PERM application submitted by your new employer, best thing and easy way to get 7th yr extension is after your PER is filed and you know how many days you are short of 365 day rule, travel outside US and com back for those number of days (maybe add a week to thosee days just for safety), recpture the time and after the recapture ur PERM will be 365 days old and apply for 7th yr extension.

Topic: 6th yr H1B layoff, 7th yr extension issue Pls advice about my options

My 6 yrs H1B with current employer is expiring in 06/22/09.
Labor applied June'07 after audit recently got apporoved Aug 2008, I-140 is not applied.

1. Now I have to change my job to a new employer in 2-3 weeks. Can my new employer apply for H1 for remiaing 8 months and + 1 yr using my previous employers LC?

2. If some how my old employer agrees to apply for I-140 and if we get the recipt notice, can my new employer use that pending I-140 and apply for H1B for 18 months including 1 yr.

what are my options, please adice
