It is not a common practice. Green card is basically for future employment purpose. Since you have worked for this employer 5 years now and they asking you to sign a green card repayment agreement is a Shame.

Did you file your I485? If your I485 is filed and it is 180 days old then you can invoke AC21 and change your employer. If not then Employer can revoke your I140.

Since this is your first post, do more research on these forums and you will see more cases like you. please do not take this as legal advice, consult your attorney before you do any action.

Topic: If EB2 PD can become DEC 03 from Unavailable status..why not EB3

The math is simple, I am guessing visa numbers gets released every quater and USCIS would determine how many cases are pending during that period. It seems like EB3 has more cases than EB2. The good thing is if EB2 quota is not used for that physical year then it can be rolled to EB3.

Topic: Surrender I-94 after GC?

I always got I94 attached for all my H1B transfers and renewals. The I94 number should be the same as the original one(which you got during your port of entry and if you did not go out of country after that) in all H1B approvals, only the dates change, which makes you legal stay in US.

Regarding the original question, I too have the same question but reading different forums; some said USCIS has our I94 records when I485 was filed and should not be a problem, but some said to return it when you go out of country.

Topic: Revoke GC if change job

I know many have mentioned that wait at least 6 months after GC. I had the same question to my attorney and their advise was to wait for 180 days after filing.

Confusion for me is, lot of members in this forum and I guess some attorney's say wait atleast 6 months after GC but my attorney said that I can quit the sponsoring company anytime after getting GC but make sure I finish 180 days after filing.

I am not sure about F1 and OPT. I had more than 5 H1B transfers, do not stress too much and take it easy.
