EB2 (India), PD of Sept 2, 2003.
CP was ticked at the time of I140.
Got I140 approved.
On H1 visa/spouse on H4 and working on temporary assignment with same employer in India since last 18 months and 4 months more to go.
In Nov, I was advised by attorney to file for AOS as PD retrogressed to 2000.
So, filed I-485 without Medical Records in Nov end (expecting RFE).
Got EAD+AP. FP is done in March.
NVC sent the case to Delhi in Dec 07.
Now got interview letter from Delhi.
I am not sure, if I can use CP option now, as I-485 was filed in Nov ? Gurus, please show the direction...
