Topic: Using AP first time

at the check-in counter they will take the I-94 from your passport....this is standard.

Supporting documents for re-entry using AP:

I-140 receipt (copy)
EAD
I-485 receipt if you have it, if not receipt number
Company letter stating years of employment and that they are the sponsors of your I-485
Last 6 pay stubs
Bank Statement
Proof of address (eg - phone bill)

and keep your current H1B if you have one (does not need to be stamped on your passport).

Get a good lawyer, you seem hell bent on going, so at this point get a very good lawyer and get his/her opinion.

I don't see how you can travel on a pending I-485 that has been submitted by a company that you no longer work for. You have to find another employer and you have to invoke the AC-21. Its brutal but this is the fact.

On departure they will take the I-94 (the one that was given to you when you landed at the airport)

On re-entry:

As long as your AP was approved while you were here you are fine. All they ask you is you passport and AP on re-entry. Just to be more confident carry the following additional documents:

I-140 receipt
EAD
I-485 receipt if you have it, if not receipt number
Company letter stating years of employment and that they are the sponsors of your I-485
Last 6 pay stubs
Bank Statement
Proof of address (eg - phone bill)

and keep your current H1B if you have one (does not need to be stamped on your passport).

Topic: October VB prediction

Well, the new fiscal year begins in Oct 2008, so the USCIS should have a full stack of visa numbers available right?. Then why would the dates return to June cut off dates (meaning no forward movement). Would there not be a forward movement by atleast 1 month for each category even conservatively speaking.

thanks Shama, the new (renewed) parole was approved on June 9'th 08, and we got it on the 17'th and she left on the 20'th, so yes we did have it before we left the US.

thank you again bmsr, but I think you misunderstood the question. My problem is not so much leaving the US, but coming back.

See :

renewd AP says valid from Aug 29 2008, to Aug 29 2009. So the new AP takes into effect only from the 29'th of Aug 2008.

At the time of her departure the renewed AP is not yet active, so should she not re-enter before the expiry of the old AP (which expires Aug 28 2008), regardless of wether she has the renewed AP on her person.

Can anyone shed some light.
