Notes: Mine is an interfiing case. I have two 140s (eb3 & eb2) approved, both have same PD (May 2004) on it. I applied 485 with eb3 140 and later I have been sending letters to interfile eb2.

Congrats. May your case be approved soon. I have a friend in yahoo who just got his GC approved even though his PD was 2005 may EB2 , India with 485 RD =15 th of July. I dont understand how this is possible with PD being current only till june 2003 for Eb2. He said others in yahoo also got who were in Eb2 and pd 2004/2005. I cant understand how 2005 pd can be approved this week.

I also saw at least one case in IV also that got approved when PD is not current. Can you find out from your friend about the service center (TSC or NSC)?

hi pyrosleepy, congrats for your approval. Could you please little bit more elaborate as to what u did for successful interfiling. I also have 2 I-140s approved with same PD and under EB2 and EB3. Unfortunately, I applied 485 with eb3 i-140 and now, am trying to interfile eb2 140. Have sent tons of letters so far but have not seen any lud any thing else. Though, senator office informed me that my both the 140s have been consolidated into one A#. Is that something fruitful?

Congratulation !!

Could you please let us know following questions:

1) do your both the 140s have same PD of eb3 140? or eb2 140 and eb3 140 have different PD?
2) Did you send interfiling letters request to USCIS?
3) Did u get any response?
4) What kind of response you got from Senator/CongressMan office for your request?
5) I have 2 140s approved with the same PD of May 2004. Unfortunately, I applied 485 with the EB3 as EB2 was not approved at that time. I have sent several letters to USCIS but no avail. Senator office got a response that said that my both the 140s have been consolidated with same A#. Whats your suggestion on my case?

Hi Guys,
We at ImmigrationVoice.org are running a campaign to let the USCIS know that they are not following the AC21 rule properly. We are seeing increasing number of cases where I-485 gets denied when someone used AC21 and his/her ex-employer revoked the 140. USCIS should issue either an rfe or NOID if candidate leaves gc sponsor company after 180 days of applying 485. USCIS is not following this rule and victims are going through ordeal of opening MTR, spending huge money and of course going through mental agony and stress. Please go through following links.

As per the 1st link, please send those 4 mails to different USCIS offices and Ombudsman. The letters are already posted in forum, you just need to fill your information and post them. Please do it irrespective of whether you are using AC21 or not or your ex-employer is revoking your 140 or not. Please remember that situation can change any time.

As per the 2nd link, we are looking for victims of this wrongdoing of USCIS. We have got a few favorable response from Ombudsman asking for a few denial letters without the personal information of candidates so that Ombudsman office can take up this issue with CIS. if anyone of you is victim, please come forward and send us the denial letter by scratching your personal info including the case number. we really appreciate your help on this.

this is absurd. Current processing dates have nothing to do with your query to USCIS. I would say, go back to senator office and request them to connect with USCIS again and get the status.
I got a fresh response from Senator's office on Friday that said that my case will be reviewed under EB2 category (desired) and I should get something in 45 days (thats the std response). Senator's office is going to send me the response via snail mail. I will update you guys again when I receive the response in mail. so far so good.

I didn't have LUD for porting, last week after seeing the LUD I spoke with IO, he said, its assigned to the officer. Just to confirm I called 2 more times, the response I got was consistent.

Unless it becomes current, its hard to say if the consolidation works. In my case when I asked them about the PD of eb2, it was never ported from eb3. I feel they do some kind of consolidation without changing the PD. You wait until it becomes current and go to the congressman's office and request them to followup.

After I got the response from the senators office I spoke with 2 attroneys about the contents of the response. Both said, USCIS takes the congressial inquiry seriously and will abide by it. Both said based on their personal experience congressial inquiry never failed.



SickOfGC, Thanks for your response. As I told you that my PD was already ported during the 2nd 140 time, thats why, I have same PD on both the eb2 and eb3 140s. Unfortunately, I applied my 485 with eb3 I-140 as at that time , eb2 was not approved (my mistake). Can you share your thoughts on consolidation in this perspective? Thx

Guys,
I got Greened today, I am very excited!!!!. Like most of you guys in this discussion I had to go through the ordeal of porting PD from eb3 to eb2. Based on my experience it works successfully if you go through senator's office. I sent 5 letters through my attroney, it didnt help. By the way, I was not happy with my attroney's letters. They were plain vanilla letters asking to port the priority dates. I composed the letter my myself based on the discussions in this forum, I went to senators office I spoke to them and gave the letter, copy of my I140's, I485's etc. They faxed the letters to uscis and in a week got back to me saying that mine will be adjudicated in eb2 category and eb3 priority of XXX. They said it will take 45 days to 120 days. This happen on sep 2nd. On sep 15th I sent to another senators, got a similar reply one week later. On Oct 28th my case was assigned to officer and today it got approved. In my case only thing hat worked is going through senators office. If you have any questions feel free to contact me. I understand how frustrating it is wait for GC. Until yesterday I was spending 3 hrs every day browsing forums to make sure I am not missing anything.

Congratulations !!! You truly deserve it.
Could you please let us know whether LUD on your 485 was due to the fact that they actually ported your PD or when they pick your 485 to adjudicate it. I also got confirmation from the senator office that my both the I-140s have been consolidated with the same A# and it will take 30 days to adjudicate it. But, I am not current based on any of 140s ( I have same PD On both the 140s that is May 2004) so I do not expect anything to happen in my case.
What is your opinion on the this "consolidate" stuff?
