Come on guys.... enough of this misinformation.
HERE ARE THE REGULATIONS FOR FOREIGNERS THAT ARE LAWFUL PERMANENT RESIDENTS OF U.S.A.:
The US government agency that enforces oversight at points of entry is the CBP.
They use a variety of systems and you can research those independently.
Here is THE statement from CBP (one of many on their website. They don't care about foreign passports)
"
Air/Land and Sea - Lawful Permanent Residents (Green card holder's) do NOT need a passport to enter the United States, however you may need a passport to enter another country. Please contact the embassy of the foreign country you will be traveling to for their requirements."
.and...
"
Foreign nationals that are lawful permanent residents of the U.S. must present a Permanent Resident Card (“Green Card”, INS Form I-551), a Reentry Permit (if gone for more than 1 year), or a Returning Resident Visa (if gone for 2 years or more) to reenter the United States. U.S. LPRs are not required by the U.S. to have a passport for travel, although most foreign destinations will require you to have one to enter their country. (LPRs that are out of the U.S. for more than 180 days are subject to new immigrant inspection procedures as per 8 USC 1101.)"
BTW, I tested this out last night when traveling from UK to US.
It works. You just need your permanent resident card (and your customs declaration completed).
ALSO: A pilot trial at JFK, IAD, and HOU will determine if they plan to expand the automated process (GLOBAL) to other gateways to speed it up further. |

I'm 50, travel all over the world as part of my job (in oslo tonight), and call north carolina home. I have a wife an plenty of children, some of whom are in college at state tuition rates. I am 9 years approaching 10 years on a H1B and GC in process since 2001 (got caught behind the big 2001 amnesty bulge) . I have never felt "trapped". I only feel liberated. I cannot understand why a mere paperwork process so dominates the minds of potential migrants who are already benefiting from most of what's on offer living in USA. There's a minimum salary by county, and a slow but fair and mostly orderly process to get you the piece of paper that tells you you're a resident alien. You can't vote in federal elections, but can vote in local and state elections, change jobs for the most part enjoy the quality of life in America, including a job, health insurance, a predictable standard of living and the chance to live in a safe community, travel, eat good food, do good things and send your children to quality schools, afford them the opportunity for growth, and for those of you who come from a less fortunate country, the opportunity to share some of your earned fortune with family abroad via monetary remittances. I cannot fathom the lack of perspective. As for complaining to politicians, well, you really need to broaden your view of the human experience. |

All this misinformation from this guy - again. There's an old maxim that if you hear "I heard it on good authority..." that it's complete BS. Here are the FACTS: A number IS NOT allocated to an individual application at application time!
The USCIS does NOT allocate a number to an actual case - in the singular - until several things have happened - we all know about most of these, including Petition for an Alien Worker approved, clearance on finger-printing and name check, certification by civil surgeon recorded, approval of adjustment of status AND... there is one number available. This is why for many AOS categories, everything can be done towards finalization pending currency. What the USCIS does is forecast on mass, and adjust each month based upon inventory of applications on hand plus expecteds, minus approvals against a yearly constraint. They have always been good with IOH, and terrible - until recently - on the expecteds. Anyone who knows anything about IMS or WMS systems can explain the concept. Please, let's just stop the second guessing and on good authority anonymous attributables. Go speak to someone who actually adjudicates cases, or maintains the software and you'll get the skinny. Anyone wants my sources, you'll need to prove you can be discreet. |

H1B is dual intent. You can come and go on a valid, current NIV + visa stamp irrespective of AOS status or stage. |

Ahem... why again are you working for a company that (assumedly) tells you:
"But with H1-B it is not possible to pay US salary as the company should not deduct social security,medicare etc but it is allowed for Green card".
OK...
1) If you employed by an American-based company (incorporated in 1 of the 50 states) AND
2) They have you on a foreign assignment, THEN
3) Nothing changes, UNLESS
4) Your are attempting to avoid taxes, in which case, you're on your AL CAPONE (cockney rhyme and pun intended). |

Topic: Embassy abroad and application for AP/EAD
You can go to India.
Take your current (only in your case) I-797 notice of action with you.
Make an appointment early enough. I've heard there is a lot of people in India.
Make sure your passport does not expire in less than 6 months from the date of application at the consulate. You will need to complete the DS-156 and if male between 14-46, the DS-157 form. Both are available on line and a scannable barcode is imaged on the documents as you print them. You will need other items, including passport-type photos etc, and payment receipts for the local processing, along with original LCA petition documentation just in case, and a letter from your employer confirming employment.
There is no risk to doing this provided you follow the rules. H1B is dual intent. Ongoing processing at USCIS is not compromised by border crossings on H1B. If that were true, there would be several hundred thousand workers in the US unable to travel across the border(s) for 7, 8 9 years.
My 10th year extension just got approved. My labor cert was originally filed in 2001. I have crossed the border at least a dozen times since then, probably around 20.
CONDITIONAL NOTE:
a) If your AP is approved before you leave, and if you have the AP (I-512) WITH YOU IN HAND BEFORE YOUR LEAVE, you can use that when returning. Use of AP DOES NOT affect future H1B status. AP is for travel only. Use of EAD only affects H1B validity;
OR
b) If your AOS is approved before you leave, and you have been to the local USCIS office and had your passport updated with the temporary Resident Alien stamp, then you can consider AP and H1B a thing of the past.
If you have a spouse and / or dependent(s), you will need to consider those implications as well. If you are planning on getting married any time soon, then you need to consider implications for spouse visas, timing etc. |

I rang the USCIS's call-vetting contractor on that service line back in early August and poured on the charm and got my receipts numbers - all 14 of them - at a time when they where shutting everyone else out. You just need to not interrupt them while they are interrupting your explanations for calling, and you'll get through to them.
6.5 b people on the planet, half living in poverty, half again of those bereft of opportunities to improve, and you can't wait of few years of your hopefully long and prosperous life waiting to join the super-rich club.
They are not playing with your life - come on, only you can do that.
Learn how to play the game of life.
If you want something to worry about, how about adopting my two elder adult children before they age out. It's a race to 21.

Finally, everyone playing this employment sponsored gc game is earning WAY more than the phone vetting service people, so chill. They are following instructions. If you want to change something, start with how you treat them.
Remember, no one is kicking you out of US while you are waiting for the GC. You still have you somewhat priv. lifestyle while you wait. My wife has had to put her career on hold for nine years and never complained once.
I grew up in a house without running water, I have no formal senior education - it's all self taught, so let's all keep this in perspective. We are the LUCKY ones. Don't celebrate your 90th birthday with "oh.... now I get it! - it's about the ride, not the destination!" |
