Topic: Any experience using AP at the YVR (Vancouver, Canada) POE?

Sorry for the late response srimatha, I was on vacation. My experience was very smooth and quick. I was sent to secondary inspection and waiter there for a few minutes (5-10 at the most) before I was called. Once I was called, my AP and passport were stamped by the officer and I was on my way. I don't think he asked me any questions. All in all, I think the whole process took about 15 minutes or so. Note that my flight was early in the morning and it was very quiet. I think there was no one in line when I got to immigration. If you get there at a busier time it would probably take longer.

For me, I expect (perhaps naively) that my PD will be current some time in the fiscal year, so I don't think my wait is going to be very long. Given that it would take some time for the I-130 to be approved, and all the hassle and expense of filing an I-130 and new I-485, I just don't think it makes much sense for me - it may not even be faster. And I really prefer not to have the government questioning my marriage.

Now, if I was expecting I was in for a multi-year wait I would probably think differently...

I am EB3-ROW with a priority date of 9/29/2005. Would getting married to a US citizen cause any problems for my pending adjustment of status? Do I need to notify USCIS, and how? I don't intend to switch to family based (although this could change if the EB3 ROW priority dates don't show any signs of advancing in the next few months), I just want to make sure that my EB application won't be negatively affected.

Thanks ratrace, I'll definitely look into it - I don't want to risk it. Of course, I hope that by December I won't have to worry about AP or being out of status any more :)

Oh, and they only paroled me until the expiration of the AP (12/2008), rather than one year. The lawyer is telling me that it doesn't matter, and I won't be out of status after that date.

I don't think so. Technically, there is a risk every time you cross the border, no matter what the method, but I don't think there is an additional risk for using AP. Just allow more time at the airport, as they always send you to secondary inspection when using AP, so it could take a lot longer if there is a line. In my case, I was flying from Canada (YVR) so I was a bit worried about not making my flight, since in Canada you clear US immigration before boarding. In the end it only took an extra 5-10 minutes, as there was no line at secondary.

My lawyer told me to have, just in case, I-485 receipt, EAD, employment verification letter and a letter explaining that I changed employers under AC-21. I was only asked for my passport and AP at the border.

Topic: Any experience using AP at the YVR (Vancouver, Canada) POE?

If you've used AP to enter at the Vancouver International Airport port of entry, can you share your experience?

I'm planning to travel from there in July. Before then, I'm changing employers and starting to work on EAD, so I will no longer have a valid H1B to enter on. Since I need to clear immigration/customs before my flight, I'd like to get an idea of how long it's going to take me so that I can plan ahead. I've read that in some cases using AP gets you sent to secondary inspection. Is this true in Vancouver? How long should I expect the wait there to take?

Also, if I'm asked about who my employer is do you think I'm going to have any problems as a result of using AC-21? My new employer's attorney is sending an AC-21 letter preemptively, but I know there is a good chance that it won't have made it into my file by then. Is giving a different employer name than my sponsor going to raise any eyebrows?
