If your 485 is approved, then 140 is definitely approved. Dont worry about it. I also learnt after lot of follow up with both USCIS and my employer, that my 140 was approved but was not reflecting on USCIS website. Its anyways employer petition so you are not required to be informed. If you think my words are too reassuring you can call USCIS and ask IO about your 140 status and you will learn it is approved. I did the same.

I never received the AP notice sent by USCIS. I tried call them but as usual I was told many excuses than actually looking into the issue. I oped a SR but to no response. Any one successfully resolved such issue ? any ideas otherwise ? |

Your dependent has to work on the EAD received during GC processing. The dependent visa staus is no longer valid. Give more details on the dependent visa status for a better answer. |

Are you sure this EAD is based on ur GC filing and not on other visa status. For eg: L2 EAD will have " FP not available" on the card. |

Since your adjustment of status is filed already if you stay in US you would automatically move on to H1 on 1st Oct. Only way you can avoid is that you can go to India in last week of September and come back to US in Oct. Since while leaving you were on L1 so you will enter also on L1 as the last action rule will prevail. Your wife will cont to be on L2. Your new I -94 will also have L1 past 1st Oct date which would mean ur aos will not happen although H1 will be valid without coming into effect. So if you want to then move to H1 file another aos as per your convinience. Make sure u give ur old I -94 while leaving in sep and get a new one in Oct.

Hi Guys.
I recd my GC sometime back. But my spouse status is still pending as per the USCIS website. Do you think calling IO can be a good idea ? I heard they dont reveal much info and what should I ask them for ? Since 485 is pending as per online status I fear they may ask me to just wait. What can be the reason for such different status? Any one in the same boat? How much time it takes for spouse case to get cleared in these kind of situations ? I am EB1 case. |
