Topic: question-I1140 pending,485 filed - change of employers

good question, you know some organisations has designations as this types (like AVP,VP (like technical manager) so on) but job we do is same like normal technical one. New employer attorney took the job description my old employer used both are matched.I will ask new employer attorney to file AC21 with all required documents like job description, offer letter, 485 recipts and so on to avoid any bad things from current employer.wish me luck.I hope every thing goes well and i will keep update this thread once every thing comes to one level (mostly by end of jan).

Topic: AC21 - Quick Reference !!

Hi S,

This is nice info, actually i am in same situation and going to do the same thing.
I am on end of 3rd year h1b and labor approved in march 2007,140 filed regular nonconcurrent on june 1st (RD),485 and EAD filed in july 25th 2007, so far 140 not approved and got excellent and good designation job in another company with same job duties.
since 140 not approved there chance my current employer may do some thing whiel i change job, i asked new employer to transfer h1b now, i am joining new employer after completing 180 days of 485 pending.

I am really in dilema what happens if 140 revoked by current employer, now i will ask my new employer to file AC21 with all information supplied in this so that i may not be in much risk.

please advice i am doing correct thing??

Topic: question-I1140 pending,485 filed - change of employers

thanks guys, the problem is why i need to join the new employer is that, they offered me very good designation (it is like VP level) which i am waiting for lost couple of years, this is one time offer and may not come again.

Really nobody should not get this type of situation and it is all because of USCIS.

Also i understand from different discusson groups 180 days limit for 485 RD right?not after 180 days after 140 approved.

people says Ac21 can be filed 140 approved and 180 days after 485 is pending.

Topic: question-I1140 pending,485 filed - change of employers

Gurus,

Please advice on my following case.
my labor approved in march2007,140 filed in june1,2007. 485 filed in july25th,2007.
I just completed my 3 years on my h1b, still 3 more years left.
I got offer to join in one company on jan end 2008 (which is 180 days after 485 pending).

since 140 still pending change of employer on h1b transfer is good idea?
what will happens in this case. please advice.
