Here is my story of the not yet fulfilled GC dream. I request any suggestions you could give me in this case. I am from India
Episode 1 : My mother was sponsored by her brother for GC thru family quota a long time ago. In 1999 the case was approved, but I was already over 21 and thus aged out. As soon as they landed in US they applied for me as an unmarried son of a green card holder.
Episode 2 : I came to USA in 2001 thru H1B from a very reputed company in India. They agreed to apply GC for me and the EB3 petition was applied in July 2002. This went into backlog processing and got eventually approved. And then I-140 was approved. Thru the visa gate fiasco in 2007 July, I applied my 485. AP and EAD are also approved.
Episode 3 : I decided to get married in 2003. I was not thinking clearly - hence I decided to stay back in USA and bring my wife in H4. My marriage was before my mother became a citizen. This caused the original application by my mother to become void. I thought that we cant get this priority date grandfathering the subsequent application - as soon as she became a citizen, she applied again for me as a married child in 2007. This application is still pending confirmation for further processing. She called the USCIS in this regard. They told her that since I am physically in USA, they cant move the application for further processing.
I have no clue if anything can be done in my case other than to wait.
Gurus, in your spare time please think abt this and let me know your thoughts. Even if you dont give me any suggestions, I truly appreciate and thank your time to just read this post |

I wish to clarify : It is acceptable that his 140 is not filed yet. He can go ahead and apply 485 and simply because he has filed 485 he would be able to stay legally here in US |

A colegue of mine is working in L1 - A. His visa expires in sep 09. I believe he can extend this visa any more. His GC is being applied in EB1. it is pending 140 approval.
If his 140 does not happen before sep 09 what possible avenue he has to stay back in USA
Any help will be much appreciated |

this are the best words that i have heard in a while. Personally I survived sep 11 and the downturn post that. All that time, I firmly held the belief that my day may not come. It is words like these that held me thru all the twists and turns.
I happen to be 2002 july pd. I have high hopes of 2009

Could we guesstimate how many months for the visa bulletin to move 9 months forward. I personally think 4 months would be reasonable

Thank for your words of encouragement. I guess we are already seeing the light at the end of the tunnel!!
If nothing happens between now and mid August, I'm very sure we will get good news in October or November.

not trying to be a big pessimist and all, but I think that nothing is going to change for eb3 till oct / nov. in oct they may resurrect the previous bulletin dates. |

Please do not take this as legal advice , you should verify with a lawer - But i am very confident that you can tide over this.
first of all, you are not out of status. your h1 in process for extension gives you more than 3 months of valid stay in US.
Second, when your 485 is pending, i think you are never out of status - correct me if I am wrong.
I agree with several posts here, the DL rules very by state. You should check if you can work with the DMV, explain the situation in greater detail and ask what they can do to help in this specific case |
