Your safe bet would hold off to switch job for a month or two until the rule is published. If you switch Job until the new employer files your labor ( its takes atleast 3 months for AD , 6-9 months for USCIS to approve labor) , I-140 date can't be used. Since you have spent only 4 years in US your wife will not be eligible , if you switch the job.

until now you cannot switch jobs with I-140 but per the proposed rule, we could change job after I-140 and file 485/AC21 with the new employer, which is not the case currently and you will have to wait :) .You could also contact lawyer for the same worth it to spend a 200$ in your case.

You must satisfy either of these conditions below

1) Primary Applicant's I-140 is approved.

2) Primary Applicant is on H1B ( Labor is Approved and is on extension (6+years) i.e I-140 is not approved ) but has been in US for over 6 years.

Your wife is covered under one of the proposed rule i.e Primary Applicant having I-140 Approved.

You might be correct , hope it is the case. It is not only a relief to H4's but the primary applications under perm processing (I-140 cleared etc), who cannot move to a different company or cannot move to the next level in the same company due to the stringent Labor rules. Hope new year brings lots of luck for all of us.

That is not required. You only need to satisfy two of the conditions for the Primary applicant

1) Primary Applicant has stayed more then 6 years in USA

or

2) I-140 has been approved.

They are also planning to provide extensions for F1 ( STEM graduates) that is different from H4 to EAD.

H4 to EAD enables to work in any field .

It was under "Proposed Rule Stage" until Spring 2014, It went to final Rule Stage in the fall.

I guess we can simply report to admin. click on the profile of the user and report . This forum is for the positiveness from H4-EAD not the otherway round. Not to demotivate or demoralize. I wish whoever feel offensive can report to the Admin.

All you need to be is out of country (US) ... Be it paid (work from country outside us) or unpaid and then you can recapture the time.

Be sure to get the details about the Audit ... Lawyers tend to hide details .. My First perm got screwed up ... Audit -->Deny-->Appeal->Deny-->BALCA . Lawyer kept saying its Govt Error(I trusted ) , finally at BALCA stage when I forced for the anwser they said , they missed my experience and job posting looked as if for fresher.. I had to refile and lost the priority and am in the 6th year too.
