Yep they will have to amend your I-140 with the successor of interest docs etc. This will take regular time that a normal I-140 takes. Mine was the same scenario amended I-140 was approved after 2.5 months of amendment application. They also amended my H1B ( just in case). I guess that is upto what your lawyers say.

Make sure you use IE for the only AR-11 form. Yes you can change your address while you are doing it - the form does ask you if you have any petition open you can tag the receipt number there and that will update your address. In my case my amended I-140 was sitting with USCIS for 2.5 months - the moment i updated my address after the move it was like a bolt of lightning to my petition - got approved the next day. Not saying it will happen to everyone - but changing your address on a pendiing petition is a must.

No dis-respect but i personally knew people who were going through the ordeal when they were brought here by TCS on L1. I was surprised to hear that this was happening. I did ask the person i knew to report it - he was too worried about his pay and ramifications that would come with that. Hence TCS exploited him to the hilt. Very humble background dude - his way out was to transfer from L1 to H1 to another company. This by any chance does not relate to the Petition in question here - but for sure shows the lengths these companies go to exploit their own country men ... That is the point here - this is really not about being Indian and discrediting them - it is about enough is enough. Worst case if you put 2 and 2 together this is how they rake up their bottom line. By paying their employees less like 65k in CA ( yeah beat that how do u survive in 65k there) daal chawal i believe... By under billing, over bidding and under paying their own employees ( mostly people from India). Why is it really hard to contemplate that they are exploiting - they can exploit employees they can exploit loop holes anything to serve their purpose. Yes they are the mass recruiters in India - they are driving the economy - nothing against that. Making employees sign contracts for 2 lacs etc all these are shabby. So the outcry that this petition only targets indian firms is just wrong. Unfortunately they are the ones who put many i know through enough misery - now if this petition atleast draws attention to their mis givings/doings so be it. Do not jump or harp at me for this..

You pretty much nailed it my friend. It is not unpatriotic to raise a voice against misuse. There is nothing unpatriotic to call out companies who are involved in exploiting loopholes. The only reason that they Indian does not mean they should go Scott free. What are we afraid of a mass tirade against Indians? Is that what is - I don;t think so - no one really cares coz besides India and China no one is stuck in this situation. And why are we getting hammered day in out figure it out. That whole apt experience was classic my man. No one is getting coaxed into signing the petitions. People are being made aware of it - if they like it they sign it if they don't want to be a part of it no hard feelings. Its fair enough. Just that by chance these companies are Indians does not make it bit different. Misuse is misuse Period.

OPT period can be used to work. You do not get OPT until you finish your coursework i believe. CPT on the other hand is a different scenario. CPT is the one that was being used by fraudulent universities to let students work from day one. As far as i know those are the facts. You also get extensions on OPT citing employment with a current employer. Earlier days OPT was for 12 months after the completion of the coursework once you graduate you get an OPT card. CPT was being abused completely which the USCIS nailed completely. Again if ur being offered an internship with IBM during your coursework you can work on CPT for a certain amount of hours along with your grad or under grad coursework. 90% of the MS students go through a lot of technicalities, balance and checks like the others. LCAs, Labor, H1B, I-140 - I485 etc etc. renewals..

well said . Our own people ?? whose side are you own brother. We all have been quiet for years - came here worked our behind to the hilt. yes 5-6 years fair deal for everyone. Haven't we all been patient? We have ... end result we got screwed by our own people - by Grassley etc. The intent is not to divide anyone. I strongly support getting rid of fraud and sweat shops. There is a value for life here for work life balance here - these companies don;t care.

Surprising thing L1 denials rose to ~ 27% so how come how the hell International Managers got clogged? Obviously they are exploiting every possible loophole. Go at the client dude and see how they function - no quality all quantity -- they won;t think twice before throwing u under the bus and make you look bad. So called out people. I am for all our people as long as the right thing is done for everyone. Otherwise we are all on our own. The President has dined with the biggies of Asian-Indian community did they ever mention us during that time ? No they will never. We all need to stand up for ourselves.

Whose getting affected now - do we have the money to lobby - they make 100$ jobs 30$ jobs collect the revenue and lobby against us?? I don't want to eradicate EB1C/EB2/EB3 but for sure at loss with the gross misuse/fraud. The genuine candidate from Big 5 Consulting to American Boutique firms have to jump through hoops to secure LCAs for us - why did all this even start at the first place???

Don;t know folks where the decisive factor lies? Abolish EB1C is not an option - there are legit ppl all across. The intent should be to stop the malpractices happening. Again its rampant in all the categories - well they have made the rules stringent with LCAs etc - same should happen there for those so called paper managers ( no free lunches ). Now if you are able to seep through the cracks after that - then its a different story. Why are we cribbing about who went where IIT, Btech, Stanford etc once you enter the real world it really does not matter. How u harness your surroundings to make yourself successful is what matters. Now where you draw your line at success is personal is someone is happy doing 60-40 and feels he has taken care of his family and personal needs so be it. If someone starts a company and feels successful so be it. Let me remind everyone here that immigration sees no boundaries as such there countries where lots of people are suffering and want to run away from their nasty situation and find save heaven here it is actually good for them from humanity perspective. Like I mentioned above it really does not matter. I am not claiming that people stuck in EB3 are fools and everyone in EB1C is a fraud. Just that these companies have been at it Scott Free!! They just keep getting innovative and set new standards in abuse. Everyone strives for a certain level of achievement and when things out of your control start affecting it frustration creeps up. Honestly i do not like the whole EVC model irony of the fact is major businesses run that way. I do not even work in that model. To clarify people bench is a concept in consulting world where whether you are on a project or not you still get paid. The desi consulting firms have given it a twist by not paying hence all the scrutiny. It is not the consultants job to look for a project there are sales/marketing teams who work for you. Obviously no one prior to GC is 1099 everyone has a 1040 W2 to go with that makes each and everyone to a great extent a full time employee who is working for a services firm who specialize is providing consulting services in multitude of technologies. That is the ideal world scenario. This whole percentage basis work, If you are on percentage no benefits business is the twisted nature of these desi consulting firms. They have successfully implemented slavery to the extent that it hampers one's confidence in self. I am not a pass out of any esteemed school in India nor USA - i am an ungrad/grad out of a private college in India and an average school in USA. But believe me when i say this that has not hampered my professional growth at all. I pretty much have everything from job satisfaction / security perspective and a damn good position but the only thing that nags at the back of my mind is the immigration hold pattern i am in. Its a damn sinusoidal curve to be honest. My coworkers and team can vouch for me - coz i created that environment for me. The point is do not start belittling people just coz your an IIT grad or some like that. This is about the economics of the situation. USA is training people giving scholarships to many students but if they do not create an environment for them to stick around as per the president it is going to affect them. End of the day that is my take. People who have gone to school here also get a better chance to get into the mix than the person who comes straight to work here. I know majority will not agree but that does make a whole lot of difference in your attitude. Makes you more on the face kind of a person. I can go on and on. The intent is not to caulk EB1C but make sure none of the people who have been exploiting the workforce back in India get their way around even here!!
