Topic: Any approval for missing LCA/PERM approval?

Has anyone received an approval and/or RFE after filing a 140 with missing LCA or PERM approval?

My 140 was filed on Aug 16 after my PERM approval came only couple of days earlier and we had no time to wait for the actual PERm approval, so instead a printout of online approval was sent instead.

i'm very very worried obviously and wanted to see if there were any out there who got approvals etc in this situation....

congrats...when was NOID issued and it was for missing PERM cert? was it lost? my 140 too applied without PERM cert to meet aug 17, 07 deadline and am worried

In order to be eligible for an EAD with a two year validity period, an applicant’s I-140, Immigrant Petition for Alien Worker, must be approved.

If this is true...why did i get a 2 yr ead...my 140 is far from being approved....and I got ead extension from tsc whereas all my 485/140 are at NSC....

i agree there's a huge difference in EB3 and eb2. I've been tracking some 140's near mine and seems most are approved...most likely eb2...mine not touched...eb3.

I am applying for renewal this week. Have appt with lawyer office tomorrow....keeping my fingers crossed EAD comes on time...otherwise I'll have to call and try to have them expedite it. When last yr I tried to get them to expedite my 140 so I could get h1 extended, they were more like "oh you have your EAD...no need for you to worry". So hope everything goes ok with EAD renewal this time.

sorry to hear about your work situation...so you are with new employer now or using EAD with same one?

I too had to go on EAD as my H1b ran out and due to filing delays by my employer for my PERM, i couldn't get the H1b extended (perm applied in 6th yr). I too am very worried being on EAD. I will feel safer and more likely to change jobs once my 140 is approved...it's very risky otherwise.

My employer is basically idiots who abuse and stress their employees...

I would say I don't have faith in the system as well...but i have faith in God. I'd have been basically screwed last year (thanks to employer) for my PERM application in 6th yr...i miraculously got my PERM approved on Aug 14th, just in time to apply for 140/485/EAD/AP. If I hadn't gotten my EAD, i would have to take unpaid leave for a while and be out of country till I was eligible for H1b extension. At least I got my EAD...i think God was on my side. I continue to pray God help me out of my work situation....

my RD is Aug 17, 2007....ND Oct 13, 2007....

LIN080105**** PD May 2007, EB3 India...concurrent...Soft LUD 01/02/08, 01/01/08, 12/31/07, 10/16/07

I have no hope for approval anytime soon and I really want to change my job NOW :( I know it's riskier if 140 is not approved. And in my case I am expecting (hoping instead of denial) a RFE for original labor cert (couldn't submit due to timing of this and approval of PERM).

Things at work are not good :( It's depressing

This seems more true for EB3....EB2 still shows movement. EB3 is at standstill esp for retrogressed countries and concurrent filers
