Hello Everyone,

I hold Indian passport and have been in US for last 5 years on H1b visa and recently got Australian PR.

Thinking of visiting Australia (March 2017) to activate my PR and at the same time planning to visit Sydney/Melbourne US consulate for H1b stamping.

Am I allowed to get stamped in Australia?
What do you suggest in this case?
Anyone you know of got a stamp in Aus?

When date becomes current and we file I 485 then it will become immigrant intention.

Currently, my wife is in India now and she is due for F1 visa interview in another 10 days. Considering my situation can my wife get EAD? Also should we cancel F1 visa interview?

Hello All,

I am in 4th year of h1, My I-140 has been approved. Recently got h1 extension for only 1year. My employer says that they have supplied I-140 along with H-1 extension, if what they say is true how come I get h-1 extension for only 1 year, ideally it should have been for 3-years.

Is there a way I can find out if he has really used my approved I-140? can FOIA help?

yeah, I am also thinking the same. convering to premium is a waste of money considering the time spent on h1 transfer. just want to see if any one has visitor visas approved while h1 is pending ?

Hello,

My current H1 is expiring on Feb 2014 and I 140 approved. have 3 more years left on 6 years cap of H1. My employer changed thier company name and they have initiated h1 transfer on their new name. It was filed in March 2013 and RFE issued in OCT 2013 and response was sent on Dec 13 2013.

My wife is pregnant and need to send parents for visa stamping to bring them here during Feb 2014. In view of my current h1 expiring Feb 2014 and H1 transfer still pending for approval. Can I still send them for visa stamping, Is it recommended?

Also on side note, I live in PA - while h1 pending can DMV renew my drivers license?

First preference would be talking to your manager, if he is with Satyam he should be able to help or else ask him to provide any other cotnacts. If none of these helpful, you will have to contact the Exit Help Desk, contact number might be in the support section of their website.

Well, in case of two pending h-1b petitions technically per USCIS you must be working with the last employer who ever gets approval.. Decide on to continue with which employer, in your case either C or D and ask the other one to revoke h-1 petition.

I was also offered multiple positions before but this is what told by lawyer. And you are OK to stay as long as your H-1b petition is in pending.

Hello Friends,

I work for company A who holds my h1 and filed my I140, USCIS issued RFE on my I140 which was filed in premium, this RFE is asking for few documents from my side, I can produce these, the same RFE is also asking for bunch of documents from company A side too but this company A is now splitting into two companies becos of various reasons. HR has called me now and saying since she needs to do more work from her side in order to resolve this RFE and they are now splitting and becoming a new company, she is trying to convince me saying that she will withdraw current I 140 will file a new one on the new company name.

At the same time I got offer from company B, if company A withdraw my I 140 application without answering RFE, and later after few days if I file my I 140 with this company B, would there be any impact because of this unanswered RFE? I have a feeling that my record with USCIS will be bad... what are your thoughts???

I am ok to not to take offer from Company B, if I have to stay back and correct this RFE. Please suggest.
