10/14/2015: Effective November 2015, USCIS Will Post Separate I-485 Filing Availability Date, Separate from State Department Visa Bulletin

USCIS announces that beginning with the November 2015 Department of State (DOS) Visa Bulletin, if USCIS determines that there are more immigrant visas available for a fiscal year than there are known applicants for such visas, USCIS will state on www.uscis.gov/visabulletininfo that applicants may use the Dates for Filing Visa Applications chart. Unless otherwise stated on our website, the Application Final Action Date chart will be used to determine when individuals may file their adjustment of status applications. USCIS anticipates making this determination each month and posting the relevant chart on our website within one week of DOS' publication of the Visa Bulletin. USCIS November 2015 Chart has yet to be released.
What does it mean? When it comes to filing of I-485 applications based on the "Filing Available" track cut-off date in each Visa Bulletin, I-485 should not rely on the monthly Visa Bulletin. They should rely on the USCIS separate posting of the USCIS chart for availability of filing track acceptance cut-off dates for the purpose of the USCIS each month. The dates can be either same or different from the Visa Bulletin Filing Acceptance chart.

10/07/2015: TRO Decision Today?

Attorneys for the plaintiffs are hopeful that the judge may make a decision today. Apparently the attorneys have collected some helpful evidence from the government through the discovery process. TRO is not primary fight. No matter which way the judge hands down the decision for TRO, the fight for lawsuit seeking declaratory judgment will continue unless the parties settle the case. Please stay tuned.

09/30/2015: House also Passed Clean Continuing Appropriations Resolution by 277:151 - NO GOVERNMENT SHUTDOWN!

The House agreed to the Senate amendments and passed the Continuing Resolutions this afternoon. Accordingly, the federal government will remain opened until 12/11/2015. The sunsetting immigration programs also survive with this Resolution.
This is a good news from the East Coast. Will we have another good news from the West Coast? Stay tuned!

i found from above round table discussion @ DHS is as under:

USCIS Service Center Operations (SCOPS) is now moving past the 2007 filing surge cases, and based on movement of the Visa Bulletin cut-off dates and an analysis of completed Form I-140s, USCIS anticipates 14,000 – 18,000 new employment-based adjustment of status filings in the coming months. Long pending applications and petitions are being reviewed on issues, such as: the job offer, changes in derivative beneficiaries, up-to-date biometrics, and needed additional evidence. SCOPS is working with the USCIS Lockboxes to ensure that they have the capacity to accept large numbers of filings, coordinating with the Application Support Centers to ensure that they are ready for increased numbers of biometric appointments, and working with the service centers to ensure that ancillary applications for advance parole and employment authorization are adjudicated in a timely manner. SCOPS also will monitor the number of incoming receipts to better coordinate with DOS.

does it mean that they will cover clear I-140 approved applicants in acceptance date (may be approved 1 year before even).... date should be between 2010 to 2012 somewhere.

my understading is like that....don't take it as granted.

09/05/2015: Stakeholder Push with White House via Petitions: STEM OPT Rule Making vs. 140/EAD Rule Making

Currently there are two groups of foreign workers who petition with the White House to initiate rule-making as soon as possible. One is the STEM OPT rule and the other is I-140/EAD rule. The White House requires 100,000 signatures for each petition by certain fixed date for the President to review and act on the program pursuant to the petitions. Readers can access the counts of signatures for each program, minute by minute, at our home page. Readers will find that there is a striking difference in the level of push for each program by stakeholdes, with overwhelming push for STEM OPT rule as opposed to 140/EAD rule. Where are 140/EAD support stakeholders, dormant? As readers can appreciate it, STEM OPT is a program for which "employers" have a huge stake with push for the rule-making, while 140/EAD program is more or less pro-foreign worker program with some level of opposition from some employers. Please check with the minute-by-minute changes with the number of signatures for each petition. Readers will find it very interesting or even stunning.
