Thanks Yaaro,

She will get her new I-94 once she reaches in US. Will she face any issue at POE?

Also I got new H1B (through company B) till Dec 2018 and she will have I-94 valid till Feb 2020. Will it create any issue in future? When I'll go for extension she might not has to go for extension in Dec 2018. How shall company B will handle this issue? Will Company B start her extension only when she approaches close to her I-94 end date?

Topic: Need HELP for H4 stamping

Hello,

I'm working on Company A and will stay with Company A till Jan 2nd 2018. I'm joining to Company B from Jan 3rd 2018.
My wife is in India and she has H4 stamping with Company A till Feb 2020. I asked Company B to provide I-797 approval copy so that my wife can go for H4 Visa stamping through Company B, but they are taking some time as people are on vacation.

Now my question, as company B may take some more time to review DS-160 & other docs and it might take some more time to book appointment for Bio-Metric and PAI, can my wife travel with the stamping through Company A (which is valid till Feb 2020) after Jan 3rd 2018? Will she face any issue at POE?

After reaching US, do Company B needs to file her I-539 immediately? Please guide.

I'm also in the same boat. My I-140 is approved on 2014 and decided to change my job. Thought with approved I-140 I can change my job and improve my career growth. Not sure if I get denial on my transfer, what are the options shall I get?

My present I-94 with the old employer is valid till Feb 2020. In case i get denial in the H1B transfer, do I need to leave US immediately? From India, Can any other company apply quota exempt H1 with my approved I-140? My old employer will withdraw I-140 in 60 days. Please guide.

Thanks trackkmygc for the quick reply. My new employer will not apply GC (as their policy got changed and they stopped filling PERM). In such case, can I keep on getting extension every after 3 years or so (as per the new rule came on Jan 2017)?

Presently I'm working in CTS in H1B and my I-140 is approved on 2014. Now I want to move out of CTS and want to join in some other company. But the company where I'm joining to, may not apply my GC. In such case if CTS withdraws my PERM/I-140, can my new employer apply for 3 years extension every after 3 year without applying new GC until the visa date become current? Please help me out.

As my I-140 is approved and I stayed with my employer for more than 180 days (3+ year), so I can change jobs (with company B, C, D, ..., Z) with that approved I-140 and every time I'll change Job I'll get 3 year, right? Can all all the future employer get 3 year extension on my H1B based on my original approved PERM & I-140?

As I belong to India, I believe it will take another 12-15 years to get my GC in hand. So I do not want to stuck with my present employer and I want to grow my career by changing jobs. My concern is that, I do not want to loose my priority date. So I want hop between companies in H1B, with my I-140 case. And when my date become current my employer (on that time) has to apply PERM, right?

Thanks Johnpa88. In case company B delay in filling PERM can I leave company B and join copy C and start new PERM to port my priority date? What is the timeline by which i need to file new PERM?


One more thing, when I got my my PERm approved from company A that time I was working in C/C++. But presently I'm working in JAVA/J2EE, Spring technologies. Will it be a problem while Company B or C files my PERM?

I'm working H1B and my I-140 is approved with Company A and priority date is on 2013. Now I got an an offer from company B. They are will to do my H1B transfer and will apply GC after 1 year. As per the new rule they can apply only supplement J form, right? What is it? If they submit Supplement J can they have to apply PERM again?

In future if they lay off me before applying PERM/Supplement J, can I join company C just doing H1B transfer? How can I take advantage of my I-140 approved (for more that 3+ year) with my current employer?

Please help me out. Thanks in advance.

Topic: Working on H4 EAD Receipt Notice

I stay in Dallas area, here we have some FM radio channel where they bring Immigration Attorneys for some QA session. Yesterday, somebody called to that Immigration Attorney through FM show and he asked the same question (whether a H4EAD can continue working with the renewal receipt notice?), but that attorney confirmed that she can work for 180 days after the expiry. That person again asked it is a H4EAD case, will it be still eligible for 180 days rule and the attorney confirmed 'yes'.

To my knowledge, one (H4EAD candidate) should not be eligible to work until he/she gets the card in hand. Look at this link - https://www.uscis.gov/working-united-states/auto...

But please consult with Attorney and get the confirmation. If possible please update here so that other gets some confirmation.

Topic: Could not renew DL as DMV could not find new I94 validity date

Hello,

I got my H1B extension approval on Feb 28 2017 and my wife's H4 did not get approval on the same day. She got approval after 3 days. Our I-797 carry same new validate date. Surprisingly online status changed as approved on April 15th.

Now when we went to DMV to renew our DL, my I94 got updated in their system with the new validity date but her I94 still carry old validity date. As a result DMV refused her to renew her DL and they told that they are going to send a manual verification letter to DHS to know about the new I94 validity date.

Later I went online to see online I94 record and I noticed that both of our I94 carry old validity date. Can we verify I94 new validity date online?

I applied her EAD extension (based on my approved I140) on Apr 17, 2017. But worried about the approval. If USCIS could not find her new I94 validity then they may issue RFE. Also if she does not receive her approval by Jun 30th 2017, she may loose her job. Please guide us what to do now. Can I call local congressman to look into the issue?

Honestly, There is no real client. That consultant company made another company with some name and made website for it. No real client will wait till you get h1B approval. Because it takes 9-10 month to get the Visa stamping after submitting H1B application on April 1st.

Hi,

Today my brother appeared for H1 Visa interview at Kolkata consulate and it was rejected. The reason VO mentioned is - Client company does not exist. VO kept I-797 approval copy and given a while white leaflet, where it is mentioned that - "Your petitioner does not appear to be either able or willing to provide qualifying employment in the US in accordance with appropriate laws and regulations"

He applied his H1B trough some consulting company and they shown some company as their client. My brother contacted this consulting company and they told that they are going to discuss with their Lawyer and take some action.

Now my question - Can lawyer do something here? Is there any chance to proceed with further documentation and reopen his H1B and appear for the Visa Stamping again?
