Topic: Birth Certificate RFE's.... ? Secondary Evidence ....Post your experience

I submitted the following documents along with my 485 application:
(1). Letter from the City Municipality with notarized translation in English indicating that registration information could not be found on their records
(2). Two affidavits - one from my mom and one from a maternal aunt (my mom's sister) - Standard bolier plate available in abundance on the web. Both written out in court paper and notarized.
(3). Birth Ceritificate obtained from my country's consulate office in the USA, which is essentially a restatement of what appears in the passport

My wife's situation was a "late registration".
(1). In her case a real Birth Certificate was available, albeit obtained late
(2). Two affidavits - one from her mom and one from a maternal Uncle (her mom's brother) - Standard bolier plate available in abundance on the web. Both written out in court paper and notarized.

There was NO RFE for either one of us.

hi

i got an RFE asking for my marriage certificate in local language, that is tamil. my marriage was registered in santhome registered office. it was in 2003. The certificate they issued is in english completely.

anyway in an hours time my parents will go there and ask for a tamil marriage cert. I just wanted to know if anyone who registered their marriage recently have a tamil marriage certificate. thanks

I went back and checked my marriage certificate. Yes, it is English. However, the signature of the registrar and also the seal of the registrar's office are in Tamil.

It was also interesting to note that all the personalized entries for me and my wife, marriage date information, parents' information etc... were all hand written!!! The title of this document was "True Extract of Hindu Marriage Register kept by Sub-Registrar's office ...". They also issued multiple "True Copies" that was entirely typed out in English, except certain sections of the document (fill in the blank style) were handwritten. Again, the signature and the seal were in Tamil.

I think you need to find out from your lawyer how to respond to an RFE of this kind.

I tried the standard POJ sequence indicated above. The final menu did not even give me option = 4. Anything to do with the time of day when the call is made?

Topic: USCIS and FBI Release Joint Plan to Eliminate Backlog of FBI Name Checks

Didn't they say that USCIS was going to go ahead and approve GCs that were held up for a response on NC from FBI for over 180 days? Remember their stated intent was to issue the GC "provisionally" pending final clearance of the NC, if they did issue a GC without that clearance being completed? I interpret this to only mean that they will continue to process NC even after the GC is mailed out, for cases where NC was still pending at the time of GC approval.

May be the USCIS has capability to sort by RD , in that case those with RD 2003-2006 will get priority :-)



malluiv - I can see why you are saying that. Let me tell you that I personally know of a family with PD in late 2003 and and RD at least one month later than what biswajitb has indicated in the profile, who got their approval in November 2007. It is all a matter of all the stars aligning in the right configuration, at the right time. In biswajitb's case, the 2 LUDs tell me that the stars are starting to align!!!

If you get a chance please read Ron Gotcher's "Visa Bulletin Cutoff" document (URL: http://www.immigration-information.com/forums/showpost.php?p=14370&postcount=135). The last paragraph in that document tells you how much of a "lottery" it can become even when a PD is supposedly current and the case is ready for adjudication.

When they are ready to tag someone's case with a visa, but DOS tells them that they have run out of it, then it looks like they simply drop that most recent "low hanging fruit" to the ground and let it rot there!!! That is when the rodents have a feast :-(

... She was very nice like I said but refused to send the fax. I think they have been told not to fax any docs.


I will not be surprised to hear that they sit in rooms that don't have fax machines!!!

Looks like there has been no approvals as yet For EB2 India. I got couple of LUDs just before the Visa Bulletin raising the hope...lets see what happens after 01April. Best of luck to everyone..


With a PD in 2001, I don't see a reason why your turn will not come as soon as the gates open!!! Technically, USCIS cannot ask DOS for a Visa number to adjudicate your case until the date is current. The softs LUDs you saw were probably the USCIS adjudicators formally documenting the fact that they won the battle against the rats (that malluiv was referring to) and successfully retrieved your paperwork from the dungeon. I think there is every reason for you to be bullish in this otherwise bearish market these days.

Come next month they will start a sweep ( i.e. employees with gas masks and rodent repellents will go to the file room and pull out files which are current for the month ) and work on the applications.


LOL - No wonder they keep requesting paperwork that you may have already submitted, through the RFE process. Before your turn comes, the rodents have probably chewed away at your documents. Must be really fat rodents by now!!!
The rate at which they are going, they may start looking for a "Pied Piper of Lincoln" or "Pied Piper of Dallas"
