The wait time for other countries India/China going to change from 5 years to 7 years for EB3 initially. Then after two years, it will become FIFO. With HR3012, the wait time for I/C will decrease to 7 years from 25 years. This is FAIR. It is unfair to cage humanity and tens of thousands of I/C higly skilled GC-candidates for two to three decades. Moreover, it is not helping America. Those who do not have GC are not likely to innovate, starts a business or buy a house.

When companies are not hiring on the basis of where a person is born, it is unfair to have GC on the basis of where you are born. If ROW complains about jumping lines , my argument is wel...we are not jumping lines. There are two lines...One of I/C and one for ROW. A person born in Lithuania or Zimbabwe with skillsets XYZ can get GC lot faster than a perosn born in china with the same credentials. The country cap for family based GC makes. There is no sense in country cap for EB GCs.

Topic: Category for "derivative adjustment" in I-485 approval notice

The Derivative must be having a priority date of Eb2 earlier than Eb3. Hence, category is E26. The Primary must hv filed under Eb3. You guys must hv filed 485 under Eb3.

Hazel could not have filed two 485s. It is illegal and both 485s will be denied.
